(a)Form, record, and oath. A witness may be questioned on direct examination and cross-examination. The person designated under Rule 25 shall put the witness on oath and shall personally, or by someone acting under the officer’s direction, record the testimony of the witness. If the person before whom the deposition is being taken is not present as set forth in Rule 25.1, the person taking down or recording the deposition shall leave record of it. The testimony shall be taken by any method authorized by Rule 27.3. Regardless of the method used to reproduce the testimony, all depositions shall be transcribed, unless all parties stipulate otherwise. The moving party will defray the stenographer’s fee, the transcript and the deponent’s copy, and shall furnish additional copies of the transcript at the expense of the requesting parties, unless otherwise ordered by the court.
(b)Objections and conduct
(1)Objections in general. No objections shall be made at a deposition, except those which are related to privileged matters or would be waived if not interposed. All other objections shall be noted upon the record of the deposition, and the answer shall be given subject to the objection, thus preserving the party’s right to apply for appropriate relief.
(2)Objections in the taking of a deposition to perpetuate a testimony. Regardless of the provisions of subdivision (a) above, when a deposition is taken to perpetuate the testimony of a party or witness, objections shall be raised as may be necessary so that the party who intends to perpetuate said testimony may rephrase the question and resolve the objections should that party deem it appropriate.
(3)Speaking objections restricted. Every objection raised during a deposition shall be stated clearly, simply and succinctly, and framed so as not to suggest an answer to the deponent. During the course of the examination, no person shall make statements or comments that interfere with the deponent’s questioning.
(4)Refusal to answer. A deponent shall answer all questions at a deposition, except (i) to preserve a privilege, (ii) to enforce a limitation set forth in an order of the court, or (iii) when the question is plainly improper and, if answered, would cause significant prejudice to any person. Therefore, an attorney shall not direct a deponent not to answer except to preserve a privilege or to enforce a court-ordered limitation. Any refusal to answer or direction not to answer a question shall be accompanied by a clear and succinct statement made for the record of the basis therefor. If a deponent refuses to answer a question, the parties may initiate a telephone conference with the judge presiding over the case in order to obtain a ruling on the matter in controversy. In such case, the parties will act as prescribed at that time by the court, which will make a record of the conference and notify it to the parties. If the judge is unavailable, the deposition will proceed as to any other matter not related to the objection.
(5)Conduct of attorneys. An attorney shall not interrupt the deposition for the purpose of communicating with the deponent, unless all the parties so stipulate, in which case the stipulation must be clearly stated for the record. Once the deposition begins, no attorney or party may order its recording suspended, except by stipulation of all the parties.
In lieu of participating in the oral examination, a party may serve written questions in a sealed envelope on the officer before whom the deposition is to be taken, who will propound them to the witness for an answer.
(a)Forma, acta y juramento. Una persona testigo podrá ser examinada mediante un interrogatorio directo y repreguntas. La persona testigo será juramentada por la persona descrita en la Regla 25 y ésta, personalmente o por medio de alguien que actúe bajo su dirección, levantará un acta del testimonio del testigo. En caso de que la persona ante quien se tome la deposición se ausente de ésta en conformidad con la Regla 25.1, el acta será levantada por la persona que tome o grabe la deposición. El testimonio de la persona testigo será tomado por cualquiera de los métodos establecidos en la Regla 27.3. Independientemente del método que se utilice para reproducirla, toda deposición deberá ser transcrita, salvo que todas las partes estipulen lo contrario. La parte promovente pagará el costo de la comparecencia del taquígrafo o taquígrafa, de la transcripción y de la copia del o de la deponente. La parte promovente deberá suplir copias adicionales de la transcripción a costo de la parte solicitante, a menos que el tribunal disponga lo contrario.
(b)Objeciones y conducta
(1)Objeciones en general. Durante el curso de una deposición sólo podrán presentarse y fundamentarse aquellas objeciones que estén relacionadas con materia protegida por algún privilegio o aquellas que se entiendan renunciadas si no se interponen. Las demás objeciones sólo se anotarán en el expediente y la contestación será dada, sujeto a la objeción, preservándose el derecho de la parte a solicitar del tribunal el remedio apropiado.
(2)Objeciones en la toma de deposición para perpetuar testimonio. No obstante lo dispuesto en el inciso (a) que antecede, cuando la deposición se toma con el propósito de perpetuar el testimonio de una parte o testigo, deberán presentarse las objeciones que sean necesarias para que la parte que pretende perpetuar dicho testimonio pueda reformular su pregunta y salvar las objeciones de entenderlo procedente.
(3)Limitación en cuanto al fundamento de las objeciones explicadas. Toda objeción interpuesta durante el curso de una deposición será consignada en una forma clara, sencilla y sucinta, y será articulada de manera que no le sugiera la contestación al o a la deponente. Durante el transcurso de una deposición, ninguna persona podrá hacer comentarios o manifestaciones que interfieran con el interrogatorio del o de la deponente.
(4)Negativa a contestar. Un o una deponente está obligado u obligada a contestar todas las preguntas que se le formulen durante el transcurso de una deposición, excepto: (i) para preservar un privilegio, (ii) para poner en vigor alguna limitación impuesta mediante orden del tribunal o, (iii) cuando la pregunta es claramente impropia y contestarla causaría gran perjuicio a una persona. Por consiguiente, un abogado o una abogada no instruirá al o a la deponente que no conteste, salvo para preservar un privilegio o poner en vigor alguna limitación impuesta mediante orden del tribunal. Cualquier negativa a contestar o instrucción para que no se conteste una pregunta deberá estar acompañada con una expresión clara y sucinta para el expediente de los fundamentos en que se basa la negativa o la instrucción. Si un o una deponente se niega a contestar una pregunta, las partes podrán iniciar una conferencia telefónica con el juez o la jueza que preside la sala ante la cual se ventila el caso, a los fines de obtener una resolución del tribunal con respecto al asunto en controversia. En tal caso, las partes actuarán en conformidad con lo dispuesto por el tribunal en ese momento, el cual levantará un acta a esos efectos que será notificada a las partes. De no estar disponible el tribunal, la deposición continuará sobre todo aquel asunto no relacionado con la objeción.
(5)Conducta de los abogados y las abogadas. Ningún abogado o abogada podrá interrumpir una deposición con el propósito de comunicarse con el o la deponente, salvo que todas las partes así lo estipulen, en cuyo caso, la estipulación debe surgir claramente del expediente. Comenzada la deposición, ningún abogado o abogada o parte podrá ordenar que se detenga el expediente, salvo que medie una estipulación de todas las partes.
En lugar de participar personalmente, una parte podrá enviar un pliego de interrogatorio en un sobre cerrado, que la persona ante la cual se va a tomar la deposición presentará al testigo para su contestación.

(a) Form, record and oath. Direct and cross-examination are both available. The Rule 25 officer swears the witness and records the testimony, personally or through someone under their direction; if that officer is absent, whoever takes or records the deposition leaves a record of that. Whatever the recording method, all depositions must be transcribed unless all parties stipulate otherwise. The party taking the deposition pays the stenographer, the transcript and the deponent’s copy, and furnishes further copies at the requesting party’s expense.

(b)(1) Objections in general. No objections are made at a deposition except those related to privileged matters or those that would be waived if not interposed. Everything else is simply noted on the record and the answer is given subject to the objection, preserving the right to seek relief later.

(b)(2) reverses that for a deposition taken to perpetuate testimony: there, objections are raised as needed so the examiner can rephrase and cure them — because there will be no second chance.

(b)(3) Speaking objections restricted. Every objection must be clear, simple and succinct, and framed so as not to suggest an answer. No one may make statements or comments that interfere with the questioning.

(b)(4) Refusal to answer. A deponent answers everything except to preserve a privilege, to enforce a court-ordered limitation, or where the question is plainly improper and would cause significant prejudice. An attorney may direct a witness not to answer only on the first two grounds, and any refusal needs a clear statement of its basis on the record. Then the striking part: the parties may open a telephone conference with the presiding judge for a ruling on the spot, with the court making a record. If the judge is unavailable the deposition proceeds on other matters.

(b)(5) Conduct. No interrupting to confer with the deponent unless all parties stipulate on the record, and once the deposition begins nobody may order the recording suspended except by stipulation of all parties.

La persona designada bajo la Regla 25 juramenta al testigo y hace constar el testimonio, personalmente o por quien actúe bajo su dirección; si no está presente, quien tome o grabe la deposición deja constancia. Sea cual sea el método, todas las deposiciones se transcriben salvo estipulación de todas las partes. Quien toma la deposición paga al estenógrafo, la transcripción y la copia de la persona deponente, y suministra copias adicionales a costa de quien las pida.

(b)(1) Objeciones en general. No se harán objeciones en deposición salvo las relativas a materias privilegiadas o las que se renunciarían de no interponerse. Todo lo demás se hace constar en el acta y la contestación se da sujeta a la objeción, preservando el derecho a pedir remedio después.

El (b)(2) invierte eso para la deposición tomada para perpetuar testimonio: allí se objeta lo necesario para que quien examina pueda reformular y resolver, porque no habrá segunda oportunidad.

(b)(3) Objeciones habladas restringidas. Toda objeción debe ser clara, sencilla y sucinta, y formulada de modo que no sugiera una contestación. Nadie puede hacer expresiones o comentarios que interfieran con el interrogatorio.

(b)(4) Negativa a contestar. La persona deponente contesta todo salvo para preservar un privilegio, hacer cumplir una limitación ordenada, o cuando la pregunta sea claramente impropia y causaría perjuicio significativo. El abogado puede instruir a no contestar solo por los dos primeros fundamentos, y toda negativa exige una expresión clara de su base en el acta. Y lo notable: las partes pueden iniciar una conferencia telefónica con el juez que preside para obtener una resolución en el momento, de la que el tribunal deja constancia. Si no está disponible, la deposición sigue con lo demás.

(b)(5) Conducta. No se interrumpe para hablar con la persona deponente salvo estipulación de todas las partes hecha constar en el acta, y comenzada la deposición nadie puede ordenar suspender la grabación salvo por estipulación de todas.
