Within the jurisdiction of the Commonwealth of Puerto Rico, depositions shall be taken before an officer authorized to administer oaths by the laws of Puerto Rico or before a person appointed by the court in which the action is pending. A person so appointed has power to administer oaths, take testimony, and preside over the taking of depositions. The person administering the oath need not stay for the taking of a deposition once the deponent has been sworn.
When a party has been recognized as an indigent litigant, the court may order that the deposition be taken under such circumstances as it deems appropriate.
En la jurisdicción del Estado Libre Asociado de Puerto Rico se tomarán las deposiciones ante una persona autorizada para tomar juramentos por las leyes de Puerto Rico o ante la persona especialmente designada por la sala ante la cual esté pendiente el pleito. La persona así designada tendrá facultad para tomar juramentos, recibir testimonios y dirigir la toma de la deposición. No es necesario que la persona que administre el juramento permanezca en la toma de la deposición una vez el deponente sea juramentado o juramentada.
Cuando una persona haya sido reconocida como litigante insolvente, el tribunal podrá ordenar la toma de la deposición bajo las circunstancias que estime convenientes.

Two categories of person may preside: an officer authorised to administer oaths by the laws of Puerto Rico, or a person appointed by the court in which the action is pending. An appointee has power to administer oaths, take testimony, and preside over the taking.

The practical sentence is the last of the first paragraph: the person administering the oath need not stay for the taking of the deposition once the deponent has been sworn. That is a real economy — it means the notary or officer swears the witness and leaves, and the deposition proceeds. Rule 27.7(a) covers what happens then: if the person before whom the deposition is taken is not present, whoever is taking or recording it leaves a record of that fact.

The second paragraph is about access. Where a party has been recognised as an indigent litigant, the court may order the deposition taken under such circumstances as it deems appropriate — a discretionary accommodation aimed at the cost of the officer and the recording.

Dos categorías pueden presidir: un funcionario autorizado por las leyes de Puerto Rico a tomar juramentos, o una persona nombrada por el tribunal donde está pendiente el pleito. Quien es nombrado tiene facultad para tomar juramentos, recibir testimonio y presidir la toma.

La oración práctica es la última del primer párrafo: quien toma el juramento no tiene que quedarse a la deposición una vez juramentada la persona deponente. Es una economía real: el notario o funcionario juramenta y se retira, y la deposición sigue. La Regla 27.7(a) cubre lo que ocurre entonces: si esa persona no está presente, quien tome o grabe la deposición dejará constancia de ello.

El segundo párrafo trata del acceso. Cuando se ha reconocido a una parte como litigante indigente, el tribunal puede ordenar que la deposición se tome en las circunstancias que estime apropiadas: una acomodación discrecional dirigida al costo del funcionario y de la grabación.
