The deposition may be taken or recorded by shorthand, stenographic means, or any other audiovisual or digital recording method that guarantees the preservation and integrity of the procedure and allows for the reproduction of the recording.
La deposición podrá ser tomada o grabada mediante taquigrafía, estenografía o cualquier otro método de grabación video-magnetofónico o digital que garantice la preservación e integridad del proceso y permita la reproducción de la grabación.
Cuando una persona sorda o que padezca una condición que le impida comunicarse efectivamente sea parte y/o deponente, la deposición deberá ser tomada mediante algún método de grabación video-magnetofónico o digital que permita la reproducción de la grabación y garantice la preservación e integridad visual del proceso, particularmente de los interrogatorios, testimonios y argumentaciones prestadas o interpretadas mediante lenguaje de señas y/o labio lectura. La parte que interesa tomar la deposición será la responsable de sufragar los gastos concernientes a la grabación.
What this rule doesQué hace esta regla
One sentence, and it is deliberately technology-neutral. The permitted methods are shorthand, stenographic means, or any other audiovisual or digital recording method — and rather than list acceptable devices, the rule states the two qualities a method must have.
It must guarantee the preservation and integrity of the procedure, and it must allow for the reproduction of the recording. A method that satisfies both qualifies, whatever it is called.
Note what follows elsewhere. Rule 27.7(a) requires that all depositions be transcribed regardless of the recording method, unless all parties stipulate otherwise. So choosing video does not remove the transcript; it adds to it unless the parties agree.
And where the parties do stipulate against transcription, Rule 27.8 gives the witness thirty days from delivery to review the recording, and Rule 27.9(d) makes the moving party keep and produce the testimony at trial in the form it was originally taken.
Una oración, deliberadamente neutral en cuanto a tecnología. Los métodos permitidos son la taquigrafía, la estenografía, o cualquier otro método audiovisual o digital de grabación; y en lugar de enumerar equipos aceptables, la regla expresa las dos cualidades que el método debe tener.
