The court, on motion of any party upon whom notice is served and for good cause shown, may enlarge or shorten the time for taking the deposition. The court may likewise determine the time, place, and order for taking the depositions, as well as all other matters covered by Rules 27.2 and 27.3, at the convenience of the parties and witnesses and in the interest of justice.
A solicitud de una parte que haya sido notificada, el tribunal podrá, por causa justificada, prorrogar o acortar el plazo para tomar la deposición. El tribunal podrá, asimismo, regular la fecha, el sitio y el orden para la toma de deposiciones, además de todas las otras materias cubiertas por las Reglas 27.2 y 27.3, de acuerdo con la conveniencia de las partes, de los testigos y de la justicia.
What this rule doesQué hace esta regla
The court’s calendar power over depositions, and it has two parts.
First, on motion of any party upon whom notice is served and for good cause shown, the court may enlarge or shorten the time for taking the deposition. That runs both ways: a party who needs more preparation gets it, and a party facing a witness about to disappear can compress the twenty days.
Second — and more broadly — the court may determine the time, place and order for taking depositions, as well as all other matters covered by Rules 27.2 and 27.3. That sweeps in everything the notice controls and the recording method too.
The standard for the second power is not good cause but the convenience of the parties and witnesses and the interest of justice — the same phrase Rule 23.4 uses when it lets the court depart from free sequencing.
La facultad de calendario del tribunal sobre las deposiciones, y tiene dos partes.
Primera: a solicitud de cualquier parte a quien se le haya notificado y con justa causa, el tribunal puede alargar o acortar el término para tomar la deposición. Corre en ambos sentidos: quien necesita más preparación la obtiene, y quien enfrenta a un testigo por desaparecer puede comprimir los veinte días.
Segunda, y más amplia: el tribunal puede determinar la hora, el lugar y el orden de las deposiciones, así como todas las demás materias de las Reglas 27.2 y 27.3. Eso barre con todo lo que controla el aviso, y también con el método de grabación.
El criterio de la segunda facultad no es la justa causa sino la conveniencia de las partes y los testigos y el interés de la justicia, la misma frase que usa la Regla 23.4 al permitir apartarse de la libre secuencia.
