What this rule doesQué hace esta regla
One sentence, and the key word is becomes. Rule 15.2 governs a party who was already a minor or already declared incompetent when the case began. This rule governs the change that happens mid-case.
The court, upon motion served as provided in Rule 22.1, may allow the action to be continued by or against the party’s guardian or guardian ad litem. The service reference matters: it borrows Rule 22.1’s scheme, which means service on parties under Rule 67 and on non-parties under Rule 4.
The power is permissive — may allow — and there is no ninety-day guillotine here. The action does not face dismissal for delay the way Rule 22.1(b) provides on death.
Rule 15.2(b) is the companion: in the situations this rule describes, the court determines the party’s mental condition and whether appointing a guardian ad litem is convenient and proper.
