The contents of the notice of appeal or the petition for certiorari must conform to the provisions of the Rules of the Circuit Court of Appeals or of the Rules of the Supreme Court, as the case may be, with the following exceptions:
(a)Identification of Complex Civil Case – The caption of the appeal or the petition must indicate, under the case number, that it is a complex civil case.
(b)Designation of Parties – It suffices to include in the caption the names of plaintiff and defendant in the case [or] the names of plaintiff and defendant in the original case, if two or more cases are consolidated, designating them as appellant and appellee or as petitioner and respondent, as appropriate. If the appeal or the petition for certiorari concerns a matter of individual or particular interest, the name of the first party that seeks review must be included. The appearing parties must be described in the opening paragraph, specifying that all plaintiffs or all defendants in the complex case—or in the original case, if two or more cases are consolidated— appear, or specifying the names of the parties that appear, if not all the parties do so.
(c)Designation of Counsel – The cover of the appeal or the petition must include the names of counsel in each Steering Committee. If a matter of particular or individual interest is involved, the name of counsel for the individual parties must also be included. The address, telephone number, fax number, and bar association number of all the above-mentioned counsel must also be included.
(d)Number of Pages – The notice of appeal or petition for certiorari must not exceed thirty-five (35) pages, exclusive of the proof of service, the index, and the appendix, unless more pages are allowed by the court. The Rules of the Circuit Court of Appeals and the Rules of the Supreme Court regarding the number of pages for notices of appeal and petitions for certiorari are not applicable to these cases.
(e)Appendix – The appendix need not include a literal copy of all the pleadings of the parties; it suffices to include a copy of one of the complaints and of one of the answers. The appendix must also include a copy of the court judgment or resolution sought to be reviewed, and of the notice of entry of a copy of the judgment or ruling in the record of the case; of any motion duly stamped by the court, resolution or order necessary to establish that the term for filing the notice of appeal or the petition for certiorari has been interrupted and has resumed, and the notice of entry of a copy of the resolution or order in the record of the case; of any document or paper that is part of the record of the court and that might be pertinent to decide the controversy; and of the updated list prepared by the Steering Committees.
El contenido del escrito de apelación o del recurso de certiorari se ajustará a lo dispuesto por el Reglamento del Tribunal de Circuito de Apelaciones o el Reglamento del Tribunal Supremo, según sea el caso, con las salvedades siguientes:
(a)Identificación de caso civil de litigación compleja - El epígrafe de toda apelación o recurso especificará debajo del número del caso que se trata de un caso civil de litigación compleja.
(b)Designación de partes - En el epígrafe bastará con escribir el nombre de las partes demandante y demandada del caso, de las partes demandante y demandada del caso matriz, de tratarse de más de un caso consolidado, designándolos como apelante y apelado o peticionario y recurrido, según sea el caso. Si se tratase de una apelación o de un recurso de certiorari de un asunto de interés particular o individual se escribirá el nombre de la primera parte que acude en apelación o certiorari. En la comparecencia será necesario describir de forma clara los o las comparecientes, lo que se hará especificando que acuden todas las partes demandantes o demandadas del caso complejo, o del caso matriz, de tratarse de más de un caso consolidado, o especificando aquellos o aquellas que comparecen, si no lo hacen todos o todas.
(c)Designación de los abogados o de las abogadas de las partes - En la cubierta del recurso se incluirá el nombre de los abogados o las abogadas integrantes de cada comité timón. En caso de que se trate de un asunto de interés particular o individual se incluirá, además de lo anterior, el nombre de las abogadas o los abogados particulares. Se incluirá, además, la dirección, el número telefónico, el número de fax y el número de colegiado o colegiada de todos los anteriores.
(d)Número de páginas - El escrito de apelación o de certiorari no excederá de treinta y cinco (35) páginas, exclusive de la certificación de notificación, del índice y del apéndice, salvo que el tribunal autorice un número mayor de páginas. Las reglas del Reglamento del Tribunal de Circuito de Apelaciones y del Reglamento del Tribunal Supremo relativas al número de páginas para los escritos de apelación y de certiorari no serán aplicables a estos casos.
(e)Apéndice - En el apéndice no será necesario incluir una copia literal de todas las alegaciones de las partes, bastando que se incluya copia de una sola de las demandas y una sola de las contestaciones. Se incluirá también una copia de la sentencia o resolución del tribunal cuya revisión se solicita y de la notificación del archivo en autos de una copia de ésta; de toda moción debidamente timbrada por el tribunal, resolución u orden necesaria para acreditar la interrupción y reanudación del término para presentar el escrito de apelación o recurso y la notificación del archivo en autos de una copia de la resolución u orden; de cualquier documento o escrito que forme parte del expediente del tribunal que sea pertinente a los fines de resolver la controversia, y de la lista actualizada preparada por los comités timón.

What this rule doesQué hace esta regla

The notice of appeal or petition for certiorari must conform to the Rules of the Circuit Court of Appeals or of the Supreme Court, as the case may be, with the following exceptions.

(a) Identification. The caption must indicate, under the case number, that it is a complex civil case — which is what routes it to the special panel under Rule 18.

(b) Designation of parties. It suffices to caption the names of plaintiff and defendant — or of the original case, where two or more were consolidated — designated as appellant and appellee, or petitioner and respondent. On a matter of individual interest, the name of the first party seeking review must be included. The opening paragraph then describes the appearing parties, specifying either that all plaintiffs or defendants appear or naming those who do.

(c) Designation of counsel. The cover must include the names of counsel in each Steering Committee, plus counsel for the individual parties where a particular interest is involved — with address, telephone, fax and bar association number for all of them.

(d) Length. Thirty-five pages, exclusive of the proof of service, the index and the appendix, unless the court allows more. The rule says expressly that the page limits in the Circuit Court of Appeals and Supreme Court rules do not apply to these cases.

(e) Appendix. It need not include a literal copy of all the pleadingsone complaint and one answer suffice, which in a case with dozens of parties is the difference between a binder and a truck. It must still include the judgment or resolution under review and the notice of its entry; any motion, resolution or order needed to show the appeal term was interrupted and resumed, with the notices of entry; any other pertinent document in the record; and the updated list prepared by the Steering Committees.

El escrito de apelación o el recurso de certiorari debe ajustarse al Reglamento del Tribunal de Circuito de Apelaciones o al del Tribunal Supremo, según corresponda, con las siguientes excepciones.

(a) Identificación. El epígrafe debe indicar, bajo el número del caso, que se trata de un caso civil de litigación compleja, que es lo que lo encamina al panel especial de la Regla 18.

(b) Designación de las partes. Basta con incluir en el epígrafe los nombres de la parte demandante y demandada —o los del caso original, si se consolidaron dos o más—, designados como apelante y apelada, o peticionaria y recurrida. En asuntos de interés individual debe incluirse el nombre de la primera parte que solicita revisión. El párrafo inicial describe entonces a las partes comparecientes, precisando si comparecen todas las demandantes o demandadas, o nombrando a las que lo hacen.

(c) Designación de los abogados. La portada debe incluir los nombres de los abogados de cada comité timón, más los de las partes individuales cuando haya interés particular, con dirección, teléfono, fax y número de colegiación de todos.

(d) Extensión. Treinta y cinco páginas, excluidos la constancia de notificación, el índice y el apéndice, salvo que el tribunal permita más. La regla dice expresamente que los límites de páginas de los reglamentos del Tribunal de Circuito de Apelaciones y del Tribunal Supremo no aplican a estos casos.

(e) Apéndice. No tiene que incluir copia literal de todas las alegaciones: basta una demanda y una contestación, lo que en un caso con decenas de partes es la diferencia entre una carpeta y un camión. Sí debe incluir la sentencia o resolución recurrida y la notificación de su archivo; toda moción, resolución u orden necesaria para establecer que el término se interrumpió y reanudó, con sus notificaciones; cualquier otro documento pertinente del expediente; y la lista actualizada preparada por los comités timón.
