These Rules will be known and must be cited as Rules for Complex Civil Litigation. They are adopted under the authority vested in this Court by Article V, Section 4 of the Constitution of the Commonwealth of Puerto Rico, by Civil Procedure Rule 71, by Supreme Court Rule 50, and by virtue of our inherent power to establish the necessary judicial procedures to facilitate the administration of justice.
Estas reglas se conocerán y se citarán como Reglas para Casos Civiles de Litigación Compleja. Se adoptan en conformidad con la autoridad concedida al Tribunal Supremo por la Sec. 4 del Art. V de la Constitución del Estado Libre Asociado de Puerto Rico, por la Regla 71 de Procedimiento Civil, por la Regla 50 del Reglamento del Tribunal Supremo y en virtud de nuestro poder inherente para establecer los procedimientos judiciales necesarios para facilitar la administración de la justicia.

What this rule doesQué hace esta regla

The name. These rules are known and must be cited as the Rules for Complex Civil Litigation.

Four sources of authority. Article V, Section 4 of the Constitution of Puerto Rico; Civil Procedure Rule 71; Supreme Court Rule 50; and the Court’s inherent power to establish the judicial procedures needed to facilitate the administration of justice.

One of those citations no longer lands. These rules were adopted in 1999, under the 1979 Rules of Civil Procedure. Rule 73 of the current rules repealed those, and the numbering moved. In the rules now in force, Rule 71 governs an error in the title of an action or in the prayer for relief — not rulemaking. So the reference here is to a 1979 provision, and it should not be read against the rule that carries the number today.

The same is true of the appendix these rules cite throughout. They point to 32 L.P.R.A. Ap. III, which is where the 1979 rules were codified. The rules in force are at Ap. V.

El nombre. Estas reglas se conocen y se citan como Reglas para Casos Civiles de Litigación Compleja.

Cuatro fuentes de autoridad. La Sección 4 del Artículo V de la Constitución de Puerto Rico; la Regla 71 de Procedimiento Civil; la Regla 50 del Reglamento del Tribunal Supremo; y el poder inherente del Tribunal para establecer los procedimientos judiciales necesarios para facilitar la administración de la justicia.

Una de esas citas ya no cae donde dice. Estas reglas se adoptaron en 1999, bajo las Reglas de Procedimiento Civil de 1979. La Regla 73 de las reglas vigentes las derogó y la numeración cambió. En las reglas de hoy, la Regla 71 trata del error en el título del pleito o en la súplica, no de la facultad de reglamentar. La referencia es a una disposición de 1979 y no debe leerse contra la regla que hoy lleva ese número.

Lo mismo ocurre con el apéndice que estas reglas citan en todo su texto. Remiten a 32 L.P.R.A. Ap. III, donde se codificaron las reglas de 1979. Las vigentes están en el Ap. V.
