The appearance of an attorney in any hearing, conference, or proceeding without being duly prepared may be considered as a conduct constitutive of obstruction to the sound administration of justice. The Court, in the exercise of its inherent power to oversee the conduct of attorneys [who] postulate before it, may, motu proprio or by request of a party, impose penalty or other sanctions, or disqualify an attorney [who] incurs conduct that is constitutive of obstruction to the sound administration of justice, or who is in dereliction of his/her duties before the Court, his/her clients or his/her fellow attorneys.
La comparecencia de un abogado o abogada a cualquier vista, conferencia o procedimiento sin estar debidamente preparado(a) podrá ser considerada conducta constitutiva de obstáculo para la sana administración de la justicia. El Tribunal, en el ejercicio de su poder inherente de supervisar la conducta de los abogados y abogadas que postulan ante sí, podrá, a iniciativa propia o a solicitud de parte, imponer sanciones económicas o de otra naturaleza o descalificar a un abogado o abogada que incurra en conducta que constituya un obstáculo para la sana administración de la justicia o infrinja sus deberes hacia el Tribunal, sus representados(as) o sus compañeros(as) abogados(as).

What this rule doesQué hace esta regla

One sentence, and it says something most rulebooks leave to custom: the appearance of an attorney at any hearing, conference or proceeding without being duly prepared may be considered conduct constituting obstruction to the sound administration of justice.

On that footing the court, exercising its inherent power over the attorneys who appear before it, may act motu proprio or on a party’s request. The available responses are a penalty or other sanctions, or disqualification of the attorney.

The reach is wider than unpreparedness alone. It also covers an attorney in dereliction of duties to the court, to clients, or to fellow attorneys. And this is the rule the others point at: Rule 9.1 sends a badly signed or offensive filing here for its sanction, and Rule 9.4 subjects self-represented parties to the same sanctions.

Una sola oración, y dice algo que la mayoría de los reglamentos deja a la costumbre: la comparecencia de un abogado a cualquier vista, conferencia o procedimiento sin estar debidamente preparado puede considerarse conducta constitutiva de obstrucción a la sana administración de la justicia.

Sobre esa base el tribunal, en ejercicio de su poder inherente sobre los abogados que postulan ante él, puede actuar motu proprio o a solicitud de parte. Las respuestas disponibles son una multa u otras sanciones, o la descalificación del abogado.

El alcance va más allá de la falta de preparación. Cubre también al abogado que incumple sus deberes ante el tribunal, sus clientes o sus compañeros. Y esta es la regla a la que apuntan las demás: la Regla 9.1 remite aquí la sanción del escrito mal firmado u ofensivo, y la 9.4 sujeta a las mismas sanciones a quien se representa por derecho propio.
