In all cases in which a personal security is required, such security shall be accompanied by an affidavit drafted and sworn by a surety stating that he or she is a resident of Puerto Rico and the owner of the real property given as security, and that he or she owns property, exclusive of property exempt from execution, worth double the amount specified in the bond over and above all his or her debts and liabilities. If there are two (2) or more sureties and their respective liability is not sufficient to answer for the total amount of the bond, they shall also state that the whole amount of their total liability is equivalent to that of a sufficient surety. The affidavit shall also set forth the place of abode of the surety and shall contain a description sufficient to identify the property he or she owns and which is given as security, an estimate of the actual value of such property, encumbrances thereon, including their amount, whether or not such encumbrances are recorded in the Registry of Property, any other bond obligation contracted by the surety and which may be standing, and any other impediment in the free use and enjoyment of the property known by the affiant.
A personal or mortgage bond furnished by the sureties suffices to authorize the court to order the Registrar of Property to record it as an encumbrance in the manner prescribed by Rule 56.7.
En todos los casos en que debe constituirse una fianza personal, ésta se acompañará de una declaración escrita y jurada por un fiador o una fiadora, en la que exprese ser residente de Puerto Rico, ser dueño o dueña del inmueble ofrecido en garantía y tener bienes, con exclusión de toda propiedad exenta de ejecución, por el doble del valor de la cantidad especificada en la obligación después de cubiertas todas sus deudas y responsabilidades. Cuando se ofrezcan dos (2) o más fiadores o fiadoras y su responsabilidad respectiva no alcance a cubrir el total de la fianza, éstos o éstas deberán hacer constar además que, sumada la responsabilidad de todos, ésta equivale a la que hubiera constituido un buen fiador o una buena fiadora. En la declaración jurada se hará constar, además, la residencia del fiador o fiadora y contendrá una descripción suficiente para identificar los bienes con que cuenta para calificarle como tal fiador o fiadora, un estimado del valor actual de dichos bienes, los gravámenes sobre éstos con expresión de su importe, consten o no dichos gravámenes en el Registro de la Propiedad, cualquier otro compromiso de fianza que haya contraído el fiador o la fiadora y que esté pendiente, y cualquier otro impedimento en el libre uso y disfrute de la propiedad que el o la declarante conozca.
La prestación de una fianza personal o hipotecaria es suficiente autorización de los fiadores o las fiadoras para que el tribunal ordene su anotación como un gravamen al Registrador o Registradora de la Propiedad en igual forma y según lo dispuesto en la Regla 56.7.

The affidavit. A personal security must be accompanied by an affidavit drafted and sworn by the surety stating that the surety is a resident of Puerto Rico, is the owner of the real property given as security, and owns property — excluding property exempt from execution — worth double the amount of the bond, over and above all debts and liabilities.
Several sureties. If there are two or more and no one of them is individually sufficient for the total, they must also state that the whole amount of their total liability is equivalent to that of a sufficient surety.
What else the affidavit must contain. The surety’s place of abode; a description sufficient to identify the property given as security; an estimate of its actual value; encumbrances on it, including their amount and whether or not they are recorded in the Registry of Property; any other bond obligation the surety has standing; and any other impediment to the free use and enjoyment of the property known to the affiant.
That is a demanding list, and it is deliberately so. An unrecorded encumbrance and an outstanding obligation on another bond are exactly the facts that make a surety look solvent on paper and be worthless in fact.
Recording it. A personal or mortgage bond furnished by the sureties suffices to authorize the court to order the Registrar of Property to record it as an encumbrance, in the manner prescribed by Rule 56.7.
La declaración jurada. La fianza personal debe acompañarse de una declaración redactada y jurada por quien fía que exprese que es residente de Puerto Rico, que es dueño del inmueble ofrecido en garantía y que posee bienes —excluidos los exentos de ejecución— por el doble de la cantidad de la fianza, por encima de todas sus deudas y responsabilidades.
Varios fiadores. Si hay dos o más y ninguno basta individualmente para el total, deben expresar además que el importe de su responsabilidad conjunta equivale al de un fiador suficiente.
Qué más debe contener. El lugar de residencia de quien fía; una descripción suficiente para identificar el bien ofrecido; una estimación de su valor real; los gravámenes que pesen sobre él, con su cuantía y si están o no inscritos en el Registro de la Propiedad; cualquier otra obligación de fianza vigente; y cualquier otro impedimento al libre uso y disfrute del bien que conozca quien declara.
Es una lista exigente, y lo es a propósito. Un gravamen no inscrito y una obligación pendiente en otra fianza son justamente los hechos que hacen que un fiador parezca solvente en el papel y no valga nada en los hechos.
Su inscripción. La fianza personal o hipotecaria prestada por los fiadores basta para que el tribunal ordene al Registrador de la Propiedad inscribirla como gravamen, en la forma que prescribe la Regla 56.7.
