(a)Notice. No preliminary injunction shall be issued without prior notice to the adverse party.
The notice shall be given as prescribed in Rule 4.4 by delivering a copy of the order to the adverse party with a copy of the application for injunction. Said delivery shall have the same effect as the delivery and service of summons under Rule 4.4.
Proof of service of notice shall be provided in the same manner allowed for the service and amendment of the summons under Rules 4.7 and 4.8.
(b)Consolidation of hearing with trial on merits. Before or after the commencement of the hearing on an application for a preliminary injunction, the court may order the trial of the action on the merits to be consolidated with said hearing. Even when this consolidation is not ordered, any evidence admitted at the hearing on the application for a preliminary injunction which would be admissible at the trial on the merits will become part of the record of the case and need not be repeated at the trial. When issuing its decision, the court shall forthwith issue an order specifying the facts it deemed proven at that stage and directing such further proceedings in the action as are just.
(a)Notificación. No se expedirá ningún auto de injunction preliminar sin notificación previa a la parte adversa. La notificación se hará del mismo modo a lo dispuesto en la Regla 4.4, entregándole a la parte adversa copia de la orden conjuntamente con copia de la petición de injunction. Dicha entrega tendrá el mismo efecto que la entrega y el diligenciamiento del emplazamiento bajo la Regla 4.4. La prueba del diligenciamiento de la notificación se hará de la misma manera permitida para el diligenciamiento y enmienda al emplazamiento bajo las Reglas 4.7 y 4.8. (b) Consolidación de la vista con el juicio en sus méritos. Antes o después de comenzada la vista para considerar una solicitud de injunction preliminar, el tribunal podrá ordenar que el juicio en sus méritos se consolide con dicha vista. Aun cuando no se ordene la consolidación, cualquier evidencia que sea admitida en la vista sobre la solicitud de injunction preliminar y que sea admisible en el juicio en sus méritos, pasará a formar parte del expediente del caso y no tendrá que presentarse nuevamente el día del juicio. El tribunal, al emitir su resolución, dictará inmediatamente una orden, especificando los hechos que ha determinado como probados en dicha etapa y ordenando los procedimientos ulteriores que sean justos en el pleito.

(a) Notice, without exception. No preliminary injunction shall be issued without prior notice to the adverse party. Unlike the TRO, there is no emergency door here.

Notice is given as prescribed in Rule 4.4, by delivering a copy of the order to the adverse party with a copy of the application. That delivery has the same effect as the delivery and service of summons under Rule 4.4. Proof of service is provided the same way as for the service and amendment of a summons under Rules 4.7 and 4.8.

(b) Consolidation with the trial. Before or after the hearing begins, the court may order the trial on the merits to be consolidated with it.

And even when it does not consolidate, any evidence admitted at the preliminary injunction hearing that would be admissible at the trial on the merits becomes part of the record and need not be repeated. Testimony given at that hearing is not a rehearsal; it is evidence in the case.

What the court must issue. When it decides, the court shall forthwith issue an order specifying the facts it deemed proven at that stage and directing such further proceedings in the action as are just. That record of what was found is what lets a later court, or an appellate one, know what the preliminary ruling actually rested on.

(a) Notificación, sin excepción. No se expedirá un injunction preliminar sin notificación previa a la parte adversa. A diferencia del entredicho, aquí no hay puerta de emergencia.

La notificación se da según la Regla 4.4, entregando copia de la orden a la parte adversa con copia de la solicitud. Esa entrega tiene el mismo efecto que la entrega y el diligenciamiento del emplazamiento bajo la Regla 4.4. La constancia de la notificación se hace igual que para el diligenciamiento y la enmienda del emplazamiento bajo las Reglas 4.7 y 4.8.

(b) Consolidación con el juicio. Antes o después de comenzada la vista, el tribunal puede ordenar que el juicio en su fondo se consolide con ella.

Y aun cuando no la ordene, toda prueba admitida en la vista de injunction preliminar que sería admisible en el juicio en su fondo pasa a formar parte del récord y no hay que repetirla. El testimonio de esa vista no es un ensayo: es prueba en el caso.

Qué debe emitir el tribunal. Al resolver, emitirá inmediatamente una orden que especifique los hechos que estimó probados en esa etapa y que disponga los procedimientos ulteriores que sean justos. Esa constancia de lo hallado es lo que permite a un tribunal posterior, o a uno apelativo, saber sobre qué descansó realmente el dictamen preliminar.
