Should it appear to the satisfaction of the court that any of the affidavits has been presented in bad faith or solely for the purpose of delay, the court shall forthwith order the party employing them to pay to the other party the amount of the reasonable expenses which the filing of the affidavits caused the other party to incur, including reasonable attorney’s fees. Any offending party or attorney may be adjudged guilty of contempt and subject to any other additional sanction provided in these rules.
Si se prueba a satisfacción del tribunal que cualquiera de las declaraciones juradas ha sido presentada de mala fe, o solamente con propósitos dilatorios, el tribunal ordenará inmediatamente a la parte responsable pagar a la otra parte el importe de los gastos razonables en que ésta incurrió como resultado de la presentación de dichas declaraciones juradas, incluso los honorarios de abogado o abogada razonables. Cualquier parte o abogado o abogada que así proceda podrá condenársele por desacato, además de cualquier otra medida o sanción dispuesta en estas reglas.

What this rule doesQué hace esta regla

The sanction that backs Rule 36.5’s requirements, and it is mandatory once the finding is made.

The trigger is that it appears to the satisfaction of the court that an affidavit was presented in bad faith or solely for the purpose of delay. Two separate grounds — an affidavit may be sincere and still be filed only to slow things down.

The consequence: the court shall forthwith order the party employing the affidavits to pay the other party the amount of the reasonable expenses which the filing caused it to incur, including reasonable attorney’s fees. "Shall" and "forthwith" — not discretionary and not deferred to the end of the case.

And the exposure goes further. Any offending party or attorney may be adjudged guilty of contempt and made subject to any other additional sanction these rules provide — which includes the Rule 9.3 sanctions that Rule 9.1 points to for a paper signed in violation of its certification.

La sanción que respalda los requisitos de la Regla 36.5, y es obligatoria una vez hecha la determinación.

El detonante es que le aparezca a satisfacción del tribunal que una declaración jurada se presentó de mala fe o con el solo propósito de dilatar. Dos fundamentos distintos: una declaración puede ser sincera y aun así presentarse solo para retrasar.

La consecuencia: el tribunal ordenará inmediatamente a la parte que las empleó pagar a la otra el importe de los gastos razonables que su presentación le causó, incluidos honorarios razonables de abogado. “Ordenará” e “inmediatamente”: ni discrecional ni diferido al final del caso.

Y la exposición va más lejos. Cualquier parte o abogado infractor puede ser declarado incurso en desacato y quedar sujeto a cualquier otra sanción adicional que estas reglas provean, lo que incluye las sanciones de la Regla 9.3 a que remite la 9.1 para un escrito firmado en violación de su certificación.
