Subject to the provisions of these rules, objection may be made at the trial or hearing to receiving in evidence any deposition or part thereof for any reason which would require the exclusion of the evidence if the witness were then present and testifying.
Con sujeción a las disposiciones de estas reglas, podrá presentarse en el juicio o vista una objeción a la admisión en evidencia de cualquier deposición o fragmento de ésta, por cualquiera de los fundamentos que requeriría su exclusión si la persona testigo está prestando entonces declaración en persona.
What this rule doesQué hace esta regla
One sentence, and it keeps the evidence rules intact. Subject to these rules, objection may be made at the trial or hearing to receiving in evidence any deposition or part of one, for any reason which would require the exclusion of the evidence if the witness were then present and testifying.
So hearsay within the deposition, irrelevance, improper opinion and the rest are all still available at the moment the deposition is offered. Rule 29.1’s conditions decide whether a deposition may be used at all; this rule decides what inside it survives.
The distinction from Rule 29.3 matters. That rule waives procedural objections — to the notice, to the officer, to curable irregularities, to the transcription — if they are not made at the right moment. Rule 29.2 preserves substantive evidentiary objections until the deposition is actually offered.
One overlap deserves care: Rule 29.3(c)(1) does not waive objections to a witness’s competency or to admissibility for failure to raise them at the deposition — unless the ground was one that might have been obviated or removed if raised then. That is the narrow class of objection you must make in the room.
Una oración, y mantiene intactas las reglas de evidencia. Sujeto a estas reglas, puede objetarse en el juicio o en la vista la admisión de cualquier deposición o parte de ella por cualquier razón que exigiría excluir la prueba si el testigo estuviera presente declarando.
Así que el testimonio de referencia dentro de la deposición, la impertinencia, la opinión indebida y lo demás siguen disponibles al momento de ofrecerla. Las condiciones de la Regla 29.1 deciden si una deposición puede usarse; esta decide qué sobrevive dentro.
La distinción con la Regla 29.3 importa. Aquella renuncia las objeciones procesales —al aviso, al funcionario, a irregularidades subsanables, a la transcripción— si no se hacen en su momento. La 29.2 preserva las objeciones probatorias sustantivas hasta que la deposición se ofrece.
Un traslape merece cuidado: la Regla 29.3(c)(1) no renuncia las objeciones a la capacidad del testigo ni a la admisibilidad por no hacerlas en la deposición, salvo que el fundamento fuera uno que pudo haberse evitado o subsanado de plantearse entonces. Esa es la clase estrecha de objeción que hay que hacer en la sala.
