When a public officer of the United States, of the Commonwealth of Puerto Rico, of its municipalities or of any of its agencies or instrumentalities is a party to an action in an official capacity and during its pendency dies, resigns, or otherwise ceases to hold office, the action does not abate, and the officer’s successor is automatically substituted as a party.
Cuando un funcionario o una funcionaria de Estados Unidos, del Estado Libre Asociado de Puerto Rico, de sus municipios o de cualquiera de sus agencias o dependencias sea parte en un pleito en su capacidad oficial, y mientras esté pendiente el pleito fallezca, renuncie o de cualquier otro modo cese en el desempeño de su cargo, el pleito no se desestimará y su sucesor o sucesora quedará automáticamente sustituido o sustituida como parte.

The cleanest rule in the group, because it requires nobody to do anything.
It reaches a public officer of the United States, the Commonwealth of Puerto Rico, its municipalities, or any of its agencies or instrumentalities who is a party in an official capacity. If during the case that officer dies, resigns, or otherwise ceases to hold office, the action does not abate and the successor is automatically substituted.
No motion, no deadline, no risk of dismissal. That is the opposite of Rule 22.1, where missing ninety days ends the case.
The reason is that an official-capacity suit is against the office rather than the person. The individual holding it is, for these purposes, a name on the caption. Note the limit: the rule applies to a party sued in an official capacity. A claim against the same person individually follows the ordinary rules — Rule 22.1 if they die.
La regla más limpia del grupo, porque no exige que nadie haga nada.
Alcanza al funcionario público de los Estados Unidos, del Estado Libre Asociado de Puerto Rico, de sus municipios, o de cualquiera de sus agencias o instrumentalidades que sea parte en su carácter oficial. Si durante el pleito muere, renuncia o de otro modo cesa en el cargo, el pleito no se extingue y su sucesor queda sustituido automáticamente.
Sin moción, sin término, sin riesgo de desestimación. Es lo contrario de la Regla 22.1, donde dejar pasar noventa días termina el caso.
La razón es que el pleito en carácter oficial va contra el cargo, no contra la persona. Quien lo ocupa es, para estos fines, un nombre en el epígrafe. Note el límite: la regla aplica a quien es demandado en su carácter oficial. La reclamación contra esa misma persona a título individual sigue las reglas ordinarias, incluida la 22.1 si fallece.
