(a)As soon as practicable after the commencement of an action brought as a class action, the court, after holding a hearing, shall determine whether to certify the action as a class action. An order under this subdivision may be conditional and may be altered or amended before final judgment.
(b)In any class action certified under Rule 20.2(c), the court shall direct to the class members the best notice practicable under the circumstances, including individual notice to all members who can be identified through reasonable effort, except when this would be so difficult that it would obstruct the prosecution of the action, in which case the court shall determine the manner in which notice shall be given. The notice shall advise each member that:
(1)the court will exclude from the class any member so requests it by a specified date,
(2)the judgment, whether favorable or not, will be binding upon all members who do not request exclusion, and
(3)any member who does not request exclusion may, if the member so desires, enter an appearance through counsel.
(c)The judgment in an action maintained as a class action under Rule 20.2(a) or (b), whether or not favorable to the class, shall include and describe those whom the court finds to be members of the class. The judgment in an action maintained as a class action under Rule 20.2(c), whether or not favorable to the class, shall include and specify or describe those to whom the notice provided in Rule 20.3(b) was directed, and who have not requested exclusion, and whom the court finds to be members of the class.
(d)When appropriate, an action may be brought or maintained as a class action with respect to particular issues, a class may be divided into subclasses and each subclass treated as a class, and the provisions of this rule shall then be construed and applied accordingly.

(c)La sentencia en un pleito tramitado como pleito de clase bajo la Regla 20.2(a) o (b), sea o no favorable a la clase, incluirá y describirá a aquellos y aquellas a quienes el tribunal determine que son miembros de la clase. What this rule doesQué hace esta regla

(a) Certification. As soon as practicable after the action is commenced, the court — after holding a hearing — determines whether to certify. The order may be conditional and may be altered or amended before final judgment. Puerto Rico requires the hearing in terms; certification is not decided on the papers.

(b) Notice, for a (c) class only. The court directs the best notice practicable, including individual notice to every member identifiable through reasonable effort — unless that would be so difficult it would obstruct the action, in which case the court sets the manner. The notice must tell each member three things: that the court will exclude anyone who asks by a stated date; that the judgment binds everyone who does not ask; and that any member who stays may appear through counsel.

(c) Who is bound. For an (a) or (b) class, the judgment includes and describes those the court finds to be members. For a (c) class, it includes and describes those to whom notice was directed, who did not request exclusion, and whom the court finds to be members. Either way the judgment binds them whether or not favourable — which is why the notice and adequacy requirements carry the weight they do.

(d) Flexibility. A class action may be brought or maintained as to particular issues, and a class may be divided into subclasses, each treated as a class.

(a) Certificación. Tan pronto sea practicable tras comenzar el pleito, el tribunal —previa vista— determina si certifica. La orden puede ser condicional y puede alterarse o enmendarse antes de la sentencia final. Puerto Rico exige la vista en sus términos: la certificación no se decide sobre los papeles.

(b) Notificación, solo para la clase (c). El tribunal dirige la mejor notificación practicable, incluida la individual a toda persona identificable mediante esfuerzo razonable, salvo que ello fuera tan difícil que obstruyera el pleito, en cuyo caso el tribunal fija la forma. La notificación debe advertir tres cosas: que el tribunal excluirá a quien lo solicite en la fecha señalada; que la sentencia obliga a quien no lo solicite; y que quien permanezca puede comparecer por medio de abogado.

(c) A quiénes obliga. Para una clase (a) o (b), la sentencia incluye y describe a quienes el tribunal halle miembros. Para una clase (c), incluye y describe a quienes se dirigió la notificación, no solicitaron exclusión, y el tribunal halla miembros. En ambos casos la sentencia obliga sea o no favorable, y por eso los requisitos de notificación y adecuacidad pesan lo que pesan.

(d) Flexibilidad. El pleito de clase puede traerse o mantenerse respecto de cuestiones particulares, y la clase puede dividirse en subclases, cada una tratada como clase.
