A class action shall not be voluntarily dismissed or compromised without the approval of the court, and notice of the proposed dismissal or compromise shall be given to all class members in such manner as the court directs.
Un pleito de clase no podrá ser desistido o transigido sin el consentimiento del tribunal, y todos los y las miembros de la clase serán notificados del propuesto desistimiento o transacción en la forma que disponga el tribunal.
What this rule doesQué hace esta regla
One sentence, and it exists because of a structural risk: the people who negotiate a class settlement are not the people who will be bound by it.
So two safeguards. The dismissal or compromise requires the approval of the court — the judge, not the parties, decides whether the deal is acceptable. And notice of the proposed dismissal or compromise shall be given to all class members, in whatever manner the court directs.
Note the reach of the notice requirement. It says all class members, without limiting itself to a Rule 20.2(c) class. The best-notice-practicable machinery in Rule 20.3(b) applies only to (c) classes, but this rule’s notice obligation is not so confined.
It also covers voluntary dismissal, not just settlement. A representative cannot simply walk away from a certified class action; the class was told the case was being pursued on their behalf.
Una oración, y existe por un riesgo estructural: quienes negocian una transacción de clase no son quienes quedarán obligados por ella.
De ahí dos salvaguardas. El desistimiento o la transacción requieren la aprobación del tribunal: decide el juez, no las partes, si el acuerdo es aceptable. Y se notificará el desistimiento o la transacción propuesta a toda la clase, en la forma que el tribunal disponga.
Fíjese en el alcance de la notificación. Dice toda la clase, sin limitarse a una clase de la Regla 20.2(c). La maquinaria de la mejor notificación practicable de la Regla 20.3(b) solo aplica a las clases (c), pero el deber de notificar de esta regla no está tan confinado.
Cubre además el desistimiento voluntario, no solo la transacción. Quien representa no puede sencillamente marcharse de un pleito de clase certificado: a la clase se le dijo que el caso se tramitaba en su nombre.
