When issues not raised by the pleadings are tried by express or implied consent of the parties, they shall be treated in all respects as if they had been raised in the pleadings. Such amendment of the pleadings as may be necessary to cause them to conform to the evidence and to raise these issues may be made upon motion of any party at any time, even after judgment; but failure to so amend shall not affect the result of the trial of these issues. If evidence is objected to at the trial on the ground that it is not within the issues made by the pleadings, the court may allow the pleadings to be amended when the presentation of the merits of the action will be subserved thereby, when the party requesting the amendment shows good cause for having failed to submit the amendment at the proper time during the proceedings, and when the admission of such evidence will not prejudice the other party’s action or defense. In passing on the motion, the court shall consider the effect of the amendment on the outcome of the case and any prejudice it may cause to the party objecting to the continuance of the hearing.
The provisions of Rules 42.4 and 67.1 shall apply whenever default is entered against a party for failure to appear.
Cuando con el consentimiento expreso o implícito de las partes se sometan a juicio cuestiones no suscitadas en las alegaciones, aquéllas se considerarán para todos los efectos como si se hubieran suscitado en las alegaciones. La enmienda a las alegaciones que sea necesaria para conformarlas a la evidencia, a los efectos de que las alegaciones reflejen las cuestiones suscitadas, podrá hacerse mediante una moción de cualquiera de las partes en cualquier momento, aun después de dictarse sentencia, pero la omisión de enmendar no afectará el resultado del juicio en relación con tales cuestiones. Si se objeta la evidencia en el juicio por el fundamento de ser ajena a las cuestiones suscitadas en las alegaciones, el tribunal podrá permitir las enmiendas, siempre que con ello se facilite la presentación del caso y la parte que presente la enmienda demuestre justa causa por la cual no pudo presentar la enmienda en el momento oportuno del proceso y que la admisión de tal prueba no perjudicará la reclamación o defensa de la otra parte. Al resolver la moción, el tribunal tomará en consideración el efecto de la enmienda sobre el resultado del caso y el perjuicio que le causa a la parte que se opone a la suspensión o continuación de la vista.
En todo caso en que haya alguna parte en rebeldía por falta de comparecencia se estará a lo dispuesto en las Reglas 42.4 y 67.1.

The first sentence is the substantive one. Issues not raised by the pleadings but tried by express or implied consent are treated in all respects as if they had been raised. The amendment is a formality — the rule says failure to amend shall not affect the result of the trial of those issues.
A motion to conform the pleadings may be made by any party at any time, even after judgment.
The second half deals with the harder case: evidence objected to at trial as outside the issues. The court may allow amendment where three things are shown — that presenting the merits will be served by it, that the party seeking the amendment shows good cause for not having submitted it earlier, and that admitting the evidence will not prejudice the objecting party’s action or defence. In ruling, the court weighs the effect on the outcome and any prejudice from continuing the hearing.
The closing sentence points elsewhere: Rules 42.4 and 67.1 apply where default is entered against a party for failure to appear.
La primera oración es la sustantiva. Las cuestiones no suscitadas en las alegaciones pero litigadas por consentimiento expreso o implícito se tratan en todo como si se hubieran suscitado. La enmienda es una formalidad: la regla dispone que no enmendar no afectará el resultado del juicio de esas cuestiones.
La moción para conformar las alegaciones puede hacerla cualquier parte en cualquier momento, incluso después de la sentencia.
La segunda mitad atiende el caso más difícil: la prueba objetada en el juicio por estar fuera de las cuestiones alegadas. El tribunal puede permitir la enmienda cuando se demuestren tres cosas: que con ello se sirve la presentación de los méritos, que quien la pide muestra justa causa por no haberla sometido antes, y que admitir la prueba no perjudicará la acción o defensa de quien objeta. Al resolver, el tribunal sopesa el efecto sobre el resultado y el perjuicio de continuar la vista.
La oración final remite a otro lugar: las Reglas 42.4 y 67.1 aplican cuando se anota la rebeldía por incomparecencia.
