A pleading shall state as a counterclaim any claim which at the time of serving the pleading the pleader has against any opposing party, if it arises out of the transaction, omission, or occurrence that is the subject matter of the opposing party’s claim and does not require for its adjudication the presence of third parties of whom the court cannot acquire jurisdiction. However, such claim need not be stated as a counterclaim if at the time the action was commenced the claim was the subject of another pending action.
Una alegación contendrá por vía de reconvención cualquier reclamación que la parte que la formula tenga contra cualquier parte adversa al momento de notificar dicha alegación, siempre que surja del acto, de la omisión o del evento que motivó la reclamación de la parte adversa y no requiera para su adjudicación la presencia de terceros sobre quienes el tribunal no pueda adquirir jurisdicción. Sin embargo, no será necesario incluir dicha reclamación mediante reconvención si al momento de comenzarse el pleito tal reclamación era ya objeto de otro pleito pendiente.

What this rule doesQué hace esta regla

Compulsory means what it says: a pleading shall state as a counterclaim any claim the pleader has against an opposing party at the time of serving the pleading, if it arises out of the transaction, omission or occurrence that is the subject matter of that party’s claim.

Two conditions limit it. The claim must exist at the time of serving the pleading — later-maturing claims go to Rule 11.4. And it must not require, for its adjudication, the presence of third parties over whom the court cannot acquire jurisdiction. A claim that cannot be decided without an unreachable party is not compulsory.

The stated exception is narrow: no counterclaim is required if, when the action was commenced, the claim was already the subject of another pending action.

The consequence of not pleading a compulsory counterclaim is not spelled out in this rule, and that is worth saying plainly: the word "shall" carries the obligation, and a party who ignores it risks being told later that the claim should have been brought here. If you notice one after the fact, Rule 11.5 is the route back in — and it is discretionary.

Obligatoria significa lo que dice: la alegación expondrá como reconvención toda reclamación que quien alega tenga contra la parte contraria al momento de notificarla, si surge de la transacción, omisión o suceso objeto de la reclamación de esa parte.

Dos condiciones la limitan. La reclamación debe existir al momento de notificar la alegación: las que vencen después van a la Regla 11.4. Y no debe requerir, para su adjudicación, la presencia de terceros sobre quienes el tribunal no pueda adquirir jurisdicción. Lo que no puede decidirse sin una parte inalcanzable no es obligatorio.

La excepción expresa es estrecha: no hace falta reconvenir si, al comenzar el pleito, la reclamación ya era objeto de otro pleito pendiente.

La consecuencia de no alegar una reconvención obligatoria no está escrita en esta regla, y conviene decirlo con claridad: el “expondrá” carga la obligación, y quien la ignora se arriesga a que después le digan que debió traerla aquí. Si la nota tarde, la Regla 11.5 es la vía de regreso, y es discrecional.
