Rule 2024.Effective Date. Pending Actions.

This transitional rule dates the chapter. Its rules took effect on the fourth day of September, 1939, but they do not apply to actions that were pending at that time. A case already underway on that day stayed outside the chapter.

The rule was adopted on February 14, 1939. The chapters of the Pennsylvania rules took effect at different times and treat pending cases differently: the minors chapter reached pending actions under Rule 2049, while the joinder chapter did not under Rule 2249. Later amendments to Rules 2001 through 2004 carry their own effective dates, which each rule’s history lists. Rule 2005, on Doe designations, came much later; it was adopted January 24, 2019, effective April 1, 2019.
