Rule 2049.Effective Date. Pending Actions.

This transitional rule dates the minors chapter. The rules took effect on the fourth day of September, 1939, and they apply to actions pending at that time. A case already underway on that date came under the chapter, including its requirement of representation by a guardian under Rule 2027 and of court approval for any settlement under Rule 2039.

Rule 2024, the effective-date rule for the chapter on real parties in interest, chose the other course: those rules, effective the same day, do not apply to pending actions. The minors rules were adopted February 14, 1939, and many have been amended since; each rule’s history lists its later amendments and their effective dates.
