Rule 2249.Effective date; pending actions.

This transitional rule dates the chapter on joinder of parties. The rules became effective on the fifth day of February, 1941, but they do not apply to actions pending at that time. A case already underway on that date was not subject to the chapter’s compulsory and permissive joinder rules. The text printed with the rule records its adoption on June 7, 1940.

The chapter took the same approach to pending actions as the chapter on the Commonwealth and political subdivisions under Rule 2124, and the opposite approach from the intervention chapter, adopted the same day, which reaches pending actions under Rule 2349. Many joinder rules have since been amended, as each rule’s history shows; Rule 2232, for example, was last amended effective January 23, 2014.
