Plain-English Summary
The longest definitions section in the code, and it is unusual for how much external medical standard it incorporates.
"Certified B-reader" means a person who completed the x-ray interpretation course sponsored by NIOSH, passed the B-reader certification examination, and whose certification is current at the time of the readings. "ILO system of classification" is the International Labor Office radiological rating system in its 2000 guidelines, as amended.
Five board certifications are separately defined — internal medicine, occupational medicine, oncology, pathology, and pulmonary medicine — each by reference to the American Board or American Osteopathic Board that grants it. The pathology definition adds a practice requirement: principally in pathology and involving regular evaluation of pathology materials from surgical or postmortem specimens.
The pulmonary function measures are defined technically: FEV1 as forced expiratory volume in the first second, FVC as forced vital capacity, and plethysmography as the chamber test for lung volume. "Pulmonary function testing" incorporates the AMA impairment guides and a named 1991 American Thoracic Society statement.
The diseases are defined too. Asbestosis is bilateral diffuse interstitial fibrosis caused by inhaling asbestos fibres. Mesothelioma is defined by the three membranes it invades — pleural, peritoneal, and pericardial. Silicosis includes acute (which may occur within months to five years of exposure), accelerated, and chronic forms.
"Nonmalignant" injuries are defined as a residual category — an asbestos-related injury other than mesothelioma or other cancer, and a silica-related injury other than cancer. That division runs through the chapter, because the criteria and the MDL treatment differ sharply between cancer and non-cancer claims.
"Silica" is respirable crystalline silicon dioxide, and "respirable" means particles under 10 microns in diameter.
