The gap-filler.
Where no specific proceeding has been provided for in these rules, the court may regulate its practice in any manner not inconsistent with them or with any applicable legal provision.
Two conditions, both required. There must be an actual gap — a situation these rules do not address — and the practice the court adopts must be consistent both with the rules and with the applicable law. A court cannot invent around a rule it dislikes, only where a rule is silent.
Compare Rule 53, which points the other direction: for special proceedings governed by statute, the statute controls and these rules fill in. Rule 72 handles the case where nothing at all speaks.
The rule has a history worth knowing. Rule 73 preserves sections of the 1933 Code of Civil Procedure that remained in force by virtue of Rule 72 of the 1979 rules — the same gap-filling provision, one generation back.
La regla que llena vacíos.
Cuando no se haya provisto un procedimiento específico en estas reglas, el tribunal podrá reglamentar su práctica en cualquier forma que no sea incompatible con ellas ni con cualquier disposición legal aplicable.
Dos condiciones, ambas exigidas. Tiene que haber un vacío real —una situación que estas reglas no atienden— y la práctica que adopte el tribunal debe ser compatible tanto con las reglas como con la ley aplicable. Un tribunal no puede inventar para rodear una regla que no le gusta, solo donde la regla calla.
Compárese con la Regla 53, que apunta al revés: en los procedimientos especiales regidos por ley, manda la ley y estas reglas complementan. La Regla 72 atiende el caso en que nada habla.
La regla tiene una historia que vale conocer. La Regla 73 preserva artículos del Código de Enjuiciamiento Civil de 1933 que quedaron vigentes en virtud de la Regla 72 de las reglas de 1979: la misma disposición que llenaba vacíos, una generación atrás.
