A provisional remedy may be granted without the filing of a bond in any of the following cases:
(a)If it appears from public or private documents, as defined by law, signed before a person authorized to administer oaths, that the obligation is legally enforceable; or
(b)If a party is indigent and expressly exempted by law from payment of filing fees and, in the opinion of the court, the complaint alleges facts sufficient to establish a cause of action which may evidently, and there are reasonable grounds to believe, after a hearing to that effect, that if such provisional remedy is not granted the resulting judgment would be moot since there would be no property against which it may be enforced; or
(c)If the remedy is sought after judgment is entered.
Whenever the court grants the provisional remedy without the filing of a bond under this rule, it may exclude certain assets from its order.
In all cases where a bond is required under this rule, the court shall require the filing of a bond sufficient to secure all the damages that may arise from the remedy. However, a defendant or respondent may retain possession of personal property attached by a plaintiff or claimant by posting a bond for an amount deemed sufficient by the court to secure the value of said property. A bond given by a defendant for the amount attached shall render the attachment ineffective.
In all bonds covered by these rules, the surety submits to the jurisdiction of the court and irrevocably appoints the clerk of the court as the surety’s agent upon whom any notice, summons or paper related to the surety’s liability may be served. The surety’s liability may be enforced on motion without the necessity of an independent action. The motion and such notice of the motion as the court prescribes may be served on the clerk of the court, who shall forthwith mail copies to the surety if the address is known.
Un remedio provisional sin la prestación de fianza podrá concederse en cualquiera de los casos siguientes:
(a)si aparece de documentos públicos o privados, según definidos por ley y firmados ante una persona autorizada para administrar juramento que la obligación es legalmente exigible, o
(b)cuando sea un litigante insolvente que esté expresamente exceptuada por ley para el pago de aranceles y derechos de presentación, y a juicio del tribunal la demanda aduce hechos suficientes para establecer una causa de acción cuya probabilidad de triunfo sea evidente o pueda demostrarse, y haya motivos fundados para temer, previa vista al efecto, que de no obtenerse inmediatamente dicho remedio provisional la sentencia que pueda obtenerse resultaría académica porque no habría bienes sobre los cuales ejecutarla, o
(c)si se gestiona el remedio después de la sentencia.
En caso de que el tribunal conceda el remedio provisional sin la prestación de fianza conforme lo dispuesto en esta regla, podrá excluir en su orden determinados bienes.
En todos los casos en que se exija una fianza bajo esta regla, el tribunal exigirá la prestación de una fianza suficiente para responder por todos los daños y perjuicios que se causen como consecuencia del aseguramiento. Una parte demandada o querellada podrá, sin embargo, retener la posesión de bienes muebles embargados por una parte demandante o reclamante prestando una fianza por la suma que el tribunal estime suficiente para responder por el valor de dicha propiedad. El afianzamiento por la parte demandada de la suma embargada dejará sin efecto el embargo.
En toda fianza bajo esta regla el fiador se somete a la jurisdicción del tribunal y designa irrevocablemente al Secretario o la Secretaria del tribunal como su agente para recibir cualquier notificación, emplazamiento o escrito relacionado con su responsabilidad como tal fiador o fiadora. Mediante una moción podrá hacerse efectiva la responsabilidad del fiador o de la fiadora sin que sea necesario instar un pleito independiente. La moción y cualquier notificación de ésta que el tribunal ordene podrán entregarse al Secretario o Secretaria del tribunal, quien remitirá inmediatamente por correo copias al fiador o fiadora, si conoce su dirección.

What this rule doesQué hace esta regla

(c) Where the remedy is sought after judgment is entered.

A safety valve. When the court grants a remedy without a bond under this rule, it may exclude certain assets from its order.

Where a bond is required, it must be sufficient to secure all the damages that may arise from the remedy. And the defendant has a counter-move: it may retain possession of attached personal property by posting its own bond in an amount the court deems sufficient to secure the property’s value. A bond given by a defendant for the amount attached renders the attachment ineffective.

The surety’s position. In all bonds under these rules, the surety submits to the jurisdiction of the court and irrevocably appoints the clerk as its agent for any notice, summons or paper about its liability. That liability may be enforced on motion, without an independent action — service on the clerk suffices, and the clerk forthwith mails copies to the surety if the address is known.

Sin fianza en tres casos. (a) Cuando de documentos públicos o privados, firmados ante persona autorizada a tomar juramentos, surja que la obligación es legalmente exigible. (b) Cuando la parte sea indigente y esté expresamente exenta por ley del pago de aranceles, la demanda alegue hechos suficientes para establecer una causa de acción y, tras una vista, haya fundamentos razonables para creer que sin el remedio la sentencia resultaría académica por no haber bienes contra los cuales ejecutarla. (c) Cuando el remedio se solicita después de dictada la sentencia.

Una válvula de escape. Cuando concede el remedio sin fianza bajo esta regla, el tribunal puede excluir ciertos bienes de su orden.

Donde se exige fianza, debe ser suficiente para responder de todos los daños que puedan surgir del remedio. Y la parte demandada tiene una jugada de respuesta: puede retener la posesión de los bienes muebles embargados prestando su propia fianza por la cantidad que el tribunal estime suficiente para garantizar el valor de esos bienes. La fianza prestada por la parte demandada por la cantidad embargada deja sin efecto el embargo.

La posición de quien fía. En todas las fianzas de estas reglas, quien fía se somete a la jurisdicción del tribunal y designa irrevocablemente al secretario como su agente para cualquier notificación, citación o escrito sobre su responsabilidad. Esa responsabilidad puede exigirse mediante moción, sin necesidad de pleito independiente: basta notificar al secretario, quien enviará copias por correo si conoce la dirección.
