Plain-English Summary

Section 25-2939 protects a party’s ability to have help in the room during mediation. An attorney may represent a party, or another individual the party designates may accompany and participate alongside the party, in the mediation itself. Mediation, unlike a courtroom, does not otherwise guarantee anyone a right to bring along counsel or support, so this section fills that gap directly.

The section also protects against a party signing away that right too early. A waiver of representation or participation given before the mediation began can be rescinded, so a party who agreed in advance to attend without an attorney or support person is not locked into that choice once the mediation is underway.

No. A waiver of representation or participation given before the mediation began can be rescinded.
