Rule 51.08.Pleadings Need Not Be Completed Before Change of Venue is Ordered.

Rule 51.08 removes a possible procedural roadblock. Someone might assume a court needs a completed pleading record — every pleading filed, every issue joined — before it can rule on a change of venue. This rule says that assumption is wrong.

A change of venue can be ordered at an early stage of the case, before the defendant has answered fully or before every claim and defense has been sorted out. This lets the venue rules in 51.02 through 51.045 operate on their own deadlines, most of which are tied to events like service of process or the answer date, instead of waiting on the pleadings to close.

The rule is brief because its job is narrow: it forecloses one specific argument for delay and lets venue transfers proceed on schedule.
