Plain-English Summary

Rule 51.01 is a short guardrail placed at the front of the venue rules. It tells judges, lawyers, and litigants that nothing in the Rules of Civil Procedure enlarges or shrinks a Missouri court’s jurisdiction, and nothing in them changes where a civil case may be filed. Those questions are answered by statutes and the constitution, not by procedural rule.

The rule matters because Rules 51.02 through 51.15 spell out detailed mechanics for moving a case from one county to another or replacing a judge. Without this savings clause, a reader might wonder whether those mechanics secretly expand a court’s authority to hear cases it otherwise could not, or whether they quietly change the legal test for proper venue. Rule 51.01 forecloses that reading. The rules that follow only govern the procedure for exercising rights that already exist elsewhere in the law.

In practice, litigants rarely cite Rule 51.01 directly. It works as an interpretive backstop: if a dispute arises over whether a venue rule altered substantive jurisdiction, courts can point back to this rule to confirm that no such change was intended.

Frequently Asked Questions

Does Rule 51.01 create any right to change venue?

No. Rule 51.01 only confirms that the procedural rules do not touch jurisdiction or venue themselves. The specific rights to seek a change of venue or a change of judge come from Rules 51.02 through 51.07.

Why does Missouri need a rule stating that procedural rules do not change jurisdiction?

Detailed venue mechanics follow immediately after this rule, and a reader could otherwise wonder whether those mechanics secretly expand a court’s reach. Rule 51.01 removes that doubt at the outset.

Does Rule 51.01 affect where I can file a lawsuit?

No. It confirms that venue is set by other law, not by this or any other procedural rule.

Who relies on Rule 51.01 in practice?

Courts and lawyers cite it mainly as an interpretive backstop when a question arises about whether a procedural rule was meant to reach jurisdiction or venue.

Has Rule 51.01 been amended since it was adopted?

No amendments are listed. It was adopted January 19, 1973, effective September 1, 1973, and has stood unchanged since.
