A deduction order entered under Part 8 of Article XII of this Act shall have the force and effect and be enforceable as a judgment.

Plain-English Summary

Section 12-802 does one job: it tells courts and creditors that a deduction order entered under Part 8 is not a lesser or specialized order -- it is a judgment. Once the court enters the order compelling an employer to withhold and remit a debtor's non-exempt wages, that order can be enforced through the same tools available for any other judgment.

That matters because Part 8 builds a fair amount of specialized procedure around how a deduction order comes to be -- the affidavit and interrogatories in Section 12-805, the employer's duties in Section 12-808, the trial process in Section 12-811. This section closes the loop by making clear that once entered, the order steps into the same enforcement framework as any other Illinois judgment, without needing a separate enforcement statute of its own.

Frequently Asked Questions

Is a wage deduction order in Illinois treated differently from other judgments once it's entered?

No. Section 12-802 gives a deduction order entered under Part 8 the same force and effect as, and makes it enforceable in the same way as, any other judgment.

Where does a deduction order come from before Section 12-802 applies?

Section 12-811 explains how the order is entered -- after the judgment creditor and judgment debtor have had a chance to contest the employer's answer or the debtor's exemption claim, and the court has tried the issues.

Does Section 12-802 create a new set of collection tools for wage deduction orders?

No. It relies on whatever enforcement tools already apply to judgments generally in Illinois rather than creating anything new specific to wage deductions.

Can a deduction order be challenged the same way other judgments are challenged?

Section 12-802 does not itself address challenges to a deduction order's validity; it addresses the order's force and effect once entered. Sections 12-807 and 12-808(f) separately address what happens if an employer fails to comply.

Does the employer or the judgment debtor bear the consequences of a deduction order's enforceability?

Section 12-808 makes the employer responsible for withholding and remitting the non-exempt wages the order covers, and Section 12-807 addresses what happens if the employer does not comply.
