Text size

No commission upon the amount of the redemption money paid in any case shall be allowed to the officer receiving the same, but the usual commission shall be allowed to the officer selling the premises, on the excess made over and above the amount of the redemption money and interest.

Plain-English Summary

Redeeming property and reselling it are different transactions, and this section keeps their compensation separate. No commission is allowed to the officer on the amount of redemption money paid in any case; taking a redemption payment doesn't itself earn the officer a cut.

Where a resale follows, as it does under Sections 12-133 through 12-135, the officer who conducts that sale keeps the usual commission, but only on the excess bid over and above the redemption money and interest, not on the full sale price.

Frequently Asked Questions

Can an officer charge a commission for accepting redemption money?

No, no commission is allowed on the amount of redemption money paid.

Can an officer earn a commission on a resale after redemption?

Yes, the usual commission, but only on the amount bid over and above the redemption money and interest.

Why treat receiving redemption money differently from conducting a sale?

Because redemption is a repayment of an existing amount, while a resale requires the officer to run a new sale and generates a distinct, commissionable excess.

Does this section set the commission rate itself?

No, it refers to the officer's usual commission without stating a rate.

Which sections describe the resale this commission attaches to?

The resale procedures set out in Sections 12-133 through 12-135.
