§ 78.102.Applicability of Subchapter: Emergency Response

A scope provision with a carve-out that keeps the chapter's two protections distinct.

The subchapter applies only to damages for personal injury, death, or property damage — other than property damage to which Subchapter A applies — arising from an error or omission of a volunteer fire department while involved in or providing an emergency response, or of a volunteer fire fighter while involved in or providing an emergency response as a member of one.

The carve-out matters because Subchapter A is the stronger protection. That section makes a volunteer department not liable at all for property damage from reasonable and necessary firefighting. This subchapter gives only the governmental unit's liability position, which is a limit rather than an immunity.

So property damage from fighting a fire stays under the absolute protection, and everything else — personal injury, death, and property damage outside that description — comes here.

"Involved in or providing" is broader than performing. It reaches a department or member engaged in the response without being the one acting, which covers the driving, the staging, and the support work an emergency involves.

The response need not be to a fire. "Emergency response" covers rescue, emergency medical, and hazardous material work, which is much of what rural volunteer departments do.
