§ 27.002.Purpose

The purpose clause of the Texas Citizens Participation Act, and it names both interests the chapter balances.

The purpose is to encourage and safeguard the constitutional rights of persons to petition, speak freely, associate freely, and otherwise participate in government to the maximum extent permitted by law and, at the same time, to protect the rights of a person to file meritorious lawsuits for demonstrable injury.

Both halves are litigated, and by opposite parties. A movant cites "to the maximum extent permitted by law" for a broad reading of what counts as protected expression. A respondent cites "meritorious lawsuits for demonstrable injury" to argue the chapter was never meant to dispose of a real claim.

The purpose clause has done real work in this chapter’s history. The 2011 statute was drafted so broadly that it swept in commercial disputes, employment cases, and family litigation that had nothing to do with public participation, and the 2019 amendments narrowed the definitions and expanded the exemptions in response.

Read against that history, the clause explains what the amendments were correcting: the first half had been operating without the second.

"Demonstrable injury" is a pointed choice of words. It signals that the protected claim is one with actual harm behind it, which aligns with the burden the ruling provision places on a respondent to establish a prima facie case for each essential element by clear and specific evidence.

The construction provision makes this clause operative rather than decorative, directing that the chapter be construed liberally to effectuate its purpose and intent fully.
