§ 15.0821.Administrative Rules for Transfer

A rulemaking directive rather than a venue rule, and the only transfer machinery this subchapter has.

The justices of the peace in each county shall, by majority vote, adopt local rules of administration regarding the transfer of a pending case from one precinct to a different precinct.

The obligation is mandatory — "shall" — and it falls on the justices collectively rather than on the county commissioners or the district judges.

Contrast the district court transfer provision, which sets out the grounds and the procedure in the statute itself. Here the Legislature specified only that rules must exist, and left their content to the justices of each county.

That makes sense given the variation. A county with one justice precinct has nothing to transfer between; a large urban county with eight has real docket-management questions the Legislature is poorly placed to answer from Austin.

The practical consequence is that the rules differ from county to county. There is no statewide answer to how a justice court case moves between precincts, and a party seeking a transfer must look to the local rules of the county where the case sits — usually available from the justice court clerk or the county's website.

Note that this concerns transfer between precincts of the same county. It says nothing about moving a case to another county, which the venue provisions of this subchapter govern instead.
