§ 103.152.Payment of Compensation

Texas pays these claims out of appropriations, and the legislature meets every other year. This section fits the claims to that calendar.

A list is due by November 1 of each even-numbered year, naming the claimants entitled to payment under Subchapter B and the amount owed for each.

It goes to the governor, the lieutenant governor and the chair of the appropriate committee in each house, which is the set of people who can put the money in a bill.

The timing is chosen to reach the next session. A November list in an even-numbered year lands weeks before the legislature convenes, while the budget is being written.

The list covers the child support component too, stating the amount to be paid to the state disbursement unit on a claimant’s behalf.

Payment is due by September 1 of the year the appropriation is made. The comptroller pays each claimant and the disbursement unit by that date, so the money moves as the new fiscal year opens.

This section is the backstop, not the ordinary route. Section 103.151 pays an approved claim within 30 days when appropriated funds are on hand, and sends a claim here only when they are not.

The delay is the cost of paying out of the treasury. A claim approved just after a session closes can wait for the next one, which is why the reporting duty is written as a hard date instead of a request.

Subsection (c) was repealed in 2009 and the repeal took effect that September 1.
