The party seeking exequatur may carry out one of the following actions in the corresponding part of the Court of First Instance:
(a)File a complaint against all the other persons affected by the foreign judgment whose recognition and enforcement is sought.
(b)File an ex parte petition signed under oath by all the persons affected by the foreign judgment whose recognition and enforcement is sought.
In all cases in which the interests of children or incompetent persons could be affected, the parents with patria potestas or the guardian of the child or incapacitated person must be included in the complaint or the ex parte petition.
La parte promovente presentará ante la sala correspondiente del Tribunal de Primera Instancia uno de los escritos siguientes:
(a)Demanda presentada contra todas las demás personas afectadas por la sentencia de otra jurisdicción cuya convalidación y reconocimiento se solicita.
(b)Solicitud ex parte suscrita bajo juramento por todas las personas afectadas por la sentencia de otra jurisdicción cuya convalidación y reconocimiento se solicita.
En todo caso en que puedan afectarse los intereses de menores o incapacitados, deberá incluirse en la demanda o en la solicitud ex parte a los padres con patria potestad o al tutor o a la tutora del o de la menor o persona incapacitada.
What this rule doesQué hace esta regla
The choice between the two forms is the choice between a contested case and an agreed one.
(a) A complaint against all the other persons affected by the foreign judgment whose recognition and enforcement is sought.
(b) An ex parte petitionsigned under oath by all the persons affected. Everyone signs, so there is no adversary — which is why it can proceed without the ordinary case structure.
Children and incapacitated persons. In all cases where their interests could be affected, the parents with patria potestas or the guardian must be included in the complaint or the petition. The trigger is possible effect, not certain effect — the safer reading is to include them whenever the judgment touches a minor or a person under guardianship.
Either form is filed in the corresponding part of the Court of First Instance.
La elección entre las dos formas es la elección entre un caso contencioso y uno acordado.
(a) Una demanda contra todas las demás personas afectadas por la sentencia extranjera cuyo reconocimiento y ejecución se solicita.
(b) Una solicitud ex partefirmada bajo juramento por todas las personas afectadas. Firman todas, de modo que no hay contraparte, y por eso puede tramitarse sin la estructura ordinaria del pleito.
Menores e incapaces. En todos los casos en que sus intereses puedan verse afectados, hay que incluir en la demanda o en la solicitud a quienes ejerzan la patria potestad o la tutela. El detonante es el efecto posible, no el efecto seguro: lo prudente es incluirlos siempre que la sentencia toque a un menor o a una persona bajo tutela.
Cualquiera de las dos formas se presenta en la sala correspondiente del Tribunal de Primera Instancia.
