(a)If a judgment directs a party to execute a conveyance of land or to deliver deeds or other documents, or to perform any other specific act and the party fails to comply within the time specified, the court may direct the act to be done at the cost of the disobedient party by some other person appointed by the court, and the act when so done has like effect as if done by the party.
Whenever necessary, on application of the party entitled to performance and upon order of the court, the clerk shall issue a writ of attachment against the property of the disobedient party to compel obedience to the judgment.
The court may, in proper cases, adjudge the party in contempt. Likewise, the court, in lieu of directing a conveyance of property, may enter a judgment divesting the title of any party and vesting it in others, and such judgment has the effect of a conveyance executed in due form of law.
When any order or judgment is for the delivery of possession, the party in whose favor it is entered is entitled to a writ of execution upon application to the clerk.
Whenever the court orders a judicial sale of personal or real property, said order shall have the force and effect of a writ directing the delivery of possession, and it shall be so stated in the judgment or order so that the marshal or any other officer may place the purchaser in possession of the property sold within a period of twenty (20) days after the sale or public auction, without prejudice to the rights of third persons who took no part in the proceeding.
(b)Judgments entered in actions for the foreclosure of mortgages and other liens shall order that plaintiff recover the debt, interests and costs through the sale of the encumbered property. To that end, an order shall issue to the marshal, to be delivered to the interested party, directing the property to be sold in satisfaction of the judgment in the manner prescribed by law for the sale of property subject to execution. If the mortgaged property cannot be found, or if the proceeds from such sale are insufficient to satisfy the judgment in full, the marshal shall collect the rest of the amount, or the remaining unpaid balance, out of any other property of the defendant as in the case of an ordinary execution.
(a)Cuando una sentencia ordene a una parte transferir el dominio de terrenos y otorgar escrituras y otros documentos, o realizar cualquier otro acto específico, y dicha parte no cumpla tal orden dentro del término especificado, el tribunal podrá ordenar que otra persona por él designada realice el acto a expensas de la parte que incumple. Cuando el acto haya sido realizado de este modo, tendrá el mismo efecto que si la parte lo hubiese ejecutado.
Si es necesario, a solicitud de la parte con derecho al cumplimiento y previa orden del tribunal, el Secretario o la Secretaria expedirá, además, un mandamiento de embargo contra los bienes de la parte que incumpla para obligarla al cumplimiento de la sentencia.
El tribunal podrá, en casos apropiados, procesar a dicha parte por desacato. Asimismo, en lugar de ordenar el traspaso de los bienes, podrá dictar sentencia para despojar del título a una parte y transferirlo a otra, y dicha sentencia tendrá el efecto de un traspaso de dominio ejecutado de acuerdo con la ley.
Cuando una orden o una sentencia disponga el traspaso de la posesión, la parte a cuyo favor se registre tendrá derecho a un mandamiento de ejecución previa solicitud al Secretario o a la Secretaria.
En todos los casos en que el tribunal ordene una venta judicial de bienes muebles o inmuebles, dicha orden tendrá la fuerza y efecto de un auto que dispone la entrega física de la posesión, por lo que deberá consignarse así en el fallo u orden para que el alguacil o la alguacila, u otro funcionario o funcionaria, proceda a poner al comprador o compradora en posesión de la propiedad vendida dentro del plazo de veinte (20) días desde la venta o la subasta, sin perjuicio de los derechos de terceros que no hayan intervenido en el procedimiento.
(b)Toda sentencia dictada en pleitos sobre ejecución de hipoteca y otros gravámenes ordenará que la parte demandante recupere su crédito, intereses y costas mediante la venta de la finca sujeta al gravamen. Al efecto, se expedirá un mandamiento al alguacil o a la alguacila, para que lo entregue a la parte interesada, en el que se disponga que proceda a venderla para satisfacer la sentencia en la forma prescrita por la ley para la venta de propiedad bajo ejecución. Si no se encuentra la finca hipotecada o si el resultado de su venta resulta insuficiente para satisfacer la totalidad de la sentencia, el alguacil o la alguacila procederá a recuperar el resto del dinero o el remanente del importe de la sentencia de cualquiera otra propiedad de la parte demandada, como en el caso de cualquiera otra ejecución ordinaria.

What this rule doesQué hace esta regla

(a) Specific acts. If a judgment directs a party to execute a conveyance of land, deliver deeds or other documents, or perform any other specific act, and the party does not comply in time, the court has four tools, and they stack.

It may direct the act to be done by someone else it appoints, at the disobedient party’s cost — and the act then has like effect as if done by the party. On application and court order, the clerk may issue a writ of attachment against the disobedient party’s property to compel obedience. The court may adjudge the party in contempt. And instead of ordering a conveyance at all, it may enter a judgment divesting title from one party and vesting it in another, which has the effect of a conveyance executed in due form of law.

Possession. When an order or judgment is for the delivery of possession, the party in whose favor it was entered is entitled to a writ of execution on application to the clerk.

A judicial sale order carries possession with it. When the court orders a judicial sale of personal or real property, that order has the force and effect of a writ directing the delivery of possession, and the judgment must say so, so the marshal may place the purchaser in possession within twenty days after the sale — without prejudice to the rights of third persons who took no part in the proceeding.

(b) Foreclosure. A foreclosure judgment orders that the plaintiff recover the debt, interests and costs through the sale of the encumbered property. An order issues to the marshal, delivered to the interested party, directing the sale in the manner prescribed by law for property subject to execution.

Deficiency. If the mortgaged property cannot be found, or the proceeds do not satisfy the judgment in full, the marshal collects the rest out of any other property of the defendant, as in an ordinary execution.

(a) Actos específicos. Si la sentencia ordena a una parte otorgar el traspaso de un inmueble, entregar escrituras u otros documentos, o realizar cualquier otro acto específico, y no cumple a tiempo, el tribunal tiene cuatro herramientas, y se suman.

Puede ordenar que el acto lo realice otra persona que designe, a costa de la parte desobediente, y el acto tendrá el mismo efecto que si lo hubiera hecho esa parte. A solicitud y por orden del tribunal, el secretario puede expedir un mandamiento de embargo contra los bienes de la parte desobediente para compeler la obediencia. El tribunal puede declararla incursa en desacato. Y en lugar de ordenar el traspaso, puede dictar una sentencia que despoje del título a una parte y lo transmita a otra, con el efecto de una escritura otorgada en debida forma de ley.

La posesión. Cuando la orden o sentencia es de entrega de posesión, la parte a cuyo favor se dictó tiene derecho al mandamiento de ejecución mediante solicitud al secretario.

La orden de venta judicial lleva la posesión consigo. Cuando el tribunal ordena la venta judicial de bienes muebles o inmuebles, esa orden tiene la fuerza y el efecto de un mandamiento de entrega de posesión, y así debe consignarse, para que el alguacil ponga en posesión a quien compra dentro de los veinte días siguientes a la venta, sin perjuicio de los derechos de terceros que no fueron parte en el procedimiento.

(b) Ejecución de hipotecas. La sentencia ordena que la parte demandante recobre la deuda, los intereses y las costas mediante la venta del bien gravado. Se expide una orden al alguacil, que se entrega a la parte interesada, para que venda el bien en la forma prescrita por ley para los bienes sujetos a ejecución.

La deficiencia. Si el bien hipotecado no aparece, o el producto de la venta no basta, el alguacil cobrará el resto de cualesquiera otros bienes de la parte demandada, como en una ejecución ordinaria.
