Rule 2965.Notice of Judgment and Execution Required by Rule 2958.2. Form.

This notice goes out with the written notice of sheriff’s sale when execution on a confessed judgment proceeds against real property under Rule 2958.2, at least thirty days before the sale. Like the other confession notices, it states the amount of the judgment and explains that it was entered without prior notice or hearing, based on a confession of judgment in a paper the defendant allegedly signed. It adds that the court has issued a writ directing the sheriff to levy upon and sell the defendant’s real property, and it gives the date of the sale.

Two warnings in capital letters follow. The defendant must file a petition for relief from the judgment, or for delay of the sale, before the sheriff’s sale. And the defendant must file a petition for relief and present it to a judge within thirty days after service. Missing either may cost the defendant their rights.
