Official Comment

Note: This new Rule 86.051 will make clear what was originally intended in respect to the publication authorized by Rule 86.05; namely, that the notice shall be required to be published only once for each of the three consecutive weeks prior to the time of hearing the petition.

Plain-English Summary

Rule 86.051 is a short clarifying rule attached to Rule 86.05's publication requirement. Rule 86.05 requires notice by publication for three consecutive weeks when personal service on a property owner is not possible. Rule 86.051 makes clear exactly how often that notice must appear during those three weeks: once a week, on the same day each week.

The official comment explains why the rule was added — to remove any doubt about what "three weeks consecutively" meant in Rule 86.05. Instead of requiring daily or repeated publication, the drafters intended a single weekly notice, repeated on the same weekday for three straight weeks, to satisfy the requirement.

For newspapers and clerks handling condemnation notices, this rule sets a workable, predictable publication schedule instead of leaving them to guess at the frequency a court might later demand.

Frequently Asked Questions

How often must condemnation notice be published under Rule 86.051?

Once each week, on the same day of the week, for the three consecutive weeks Rule 86.05 requires.

Why was Rule 86.051 added if Rule 86.05 already requires publication?

It clarifies what Rule 86.05's three-week publication requirement was always meant to mean: one notice per week, not repeated publication within a single week.

Does the notice have to run on the same day each week?

Yes, the rule specifically requires the notice to be published on the same day of each week during the three-week period.

Does Rule 86.051 change who receives notice by publication?

No. It only addresses the frequency of publication; Rule 86.05 still governs who qualifies for publication notice instead of personal service.

Is Rule 86.051 a standalone notice requirement?

No, it applies specifically to the publication notice described in Rule 86.05 and has no independent function apart from that rule.
