Plain-English Summary

This one-sentence section makes Article 2 an extra tool rather than an exclusive one. The remedies provided in the article are in addition to, and not in substitution of, any other remedies. A person owed support under the Uniform Reciprocal Enforcement of Support Act didn’t give up other ways to collect by using it, and the act didn’t displace other enforcement law.

Cumulative-remedy clauses like this one are common in uniform acts. They prevent a court from reading the new law as the only path, which could leave an obligee worse off than before. The article itself also included criminal enforcement tools, such as the extradition provisions of § 19-11-48 for an obligor charged with failing to provide support.

Like the rest of Article 2, this section now governs only proceedings pending before January 1, 1998. Section 19-11-40.1 bars new petitions and proceedings under the article on or after that date and sends them to Article 3, the Uniform Interstate Family Support Act, which begins at § 19-11-100. Georgia law offers many other support enforcement remedies outside this article, such as the child support enforcement agency’s collection tools in § 19-11-18. The section dates to Georgia’s original 1958 enactment.

Frequently Asked Questions

Did using URESA prevent other ways of collecting support?

No. This section says the remedies provided in the article are in addition to and not in substitution of any other remedies. A person owed support could use URESA without giving up other legal means of enforcing the duty of support.

What does “remedies cumulative” mean?

It means the remedies stack. The article’s remedies are added to whatever other remedies the law already provides, rather than replacing them. A court should not read Article 2 as the only way to enforce a support duty across state lines.

Does this section matter for a child support case today?

Only for a proceeding pending before January 1, 1998. Section 19-11-40.1 bars new petitions and proceedings under this article on or after that date. A new interstate case is governed by the Uniform Interstate Family Support Act, beginning at § 19-11-100.

What other remedies exist for collecting child support in Georgia?

Many, outside this article. For example, § 19-11-18 authorizes the child support enforcement agency to use collection procedures for arrearages, including liens and levies, and §§ 19-11-32 through 19-11-38 set out its administrative bank levy process. For interstate cases, the Uniform Interstate Family Support Act, beginning at § 19-11-100, provides its own enforcement tools.

Did URESA include criminal enforcement?

It included extradition provisions. Under § 19-11-48, the Governor may demand from another state’s governor a person charged in Georgia with the crime of failing to provide for the support of someone in Georgia, and may surrender a person found here who is charged in another state with that crime. Those tools sit alongside the article’s civil remedies.
