§ 87.002.Applicability of Chapter

One sentence: this chapter does not apply to an activity regulated by the Texas Racing Commission.

The Commission regulates horse and greyhound racing in Texas — the licensed pari-mutuel industry, with its own statutory scheme, its own licensing, and its own rules about who may participate and on what terms.

That industry did not need this chapter and would have been ill served by it. Commercial racing is a regulated business with insurance requirements and contractual arrangements among owners, trainers, jockeys, and tracks. A blanket inherent-risk immunity would have cut across them.

The exclusion is by regulator, not by activity. An activity regulated by the Commission is outside the chapter; a horse activity that is not — a rodeo, a riding school, a trail ride, a private race — remains within it.

Note that the chapter expressly includes rodeos and single event competitions such as team roping, calf roping, and single steer roping, without regard to whether the participants are compensated. So competitive equine events are covered unless the Racing Commission regulates them.

The following section adds a second boundary, preserving the workers' compensation laws.
