Plain-English Summary

The posted-warning route to protection, and the requirements are specific.

An agritourism entity must post and maintain a sign in a clearly visible location on or near any premises on which an agritourism activity is conducted, containing the language the section prescribes.

Three obligations are packed into that sentence. The sign must be posted, must be maintained, and must be in a clearly visible location. A faded or obscured sign does not satisfy a maintenance requirement.

"Any premises on which an agritourism activity is conducted" means a single sign at the entrance may not be enough where activities happen across a large property.

The prescribed language begins with the heading WARNING, then states that under this chapter an agritourism entity is not liable for injury to or death of a participant resulting from an agritourism activity.

The wording tells participants exactly what they are accepting, which is the theory of the whole 75-series: the protection is earned by giving notice, not by the activity being inherently risky.

Note that this section is one of only two routes. An entity that cannot post a sign at every location may instead obtain individual signed agreements under the next section.
