§ 71.011.Damages Not Subject to Debts

One sentence protecting the recovery: damages recovered under this subchapter are not subject to the debts of the deceased.

The rule follows from whose claim it is. Wrongful death damages compensate the survivors for their own losses, and the money never belongs to the decedent or the estate. A creditor of the decedent has no claim to it.

The protection is substantial in practice. A death frequently leaves large medical bills and other debts, and without this section a family's recovery could be consumed by them before reaching anyone.

Contrast the survival action. Those damages belong to the estate, compensate what the decedent suffered, and are available to creditors in the ordinary course of administration.

Since the two claims are usually pleaded together and tried to one jury, the allocation between them has a real consequence for the family: what the jury assigns to wrongful death reaches the survivors intact, and what it assigns to survival passes through the estate.

Note the parallel in the wrongful death defendant provision, under which a judgment against a deceased defendant is paid in due course of administration — the estate's creditors and this claimant are ranked there in the ordinary way.
