§ 145.001.Definitions

Three definitions, each drawn around the same idea: someone entering a home for a fee.

"In-home service company" means a person who employs a person to enter another person’s residence and for a fee repair: an appliance; the residence’s heating, air-conditioning and ventilation system; its plumbing system; or its electrical system.

Four categories of repair, and no others. A company entering homes to clean, paint, landscape, or install cable falls outside the definition, however similar the risk.

"Residential delivery company" means a person who employs someone to, for a fee, deliver an item to another person’s residence and enter the residence to place, assemble, or install the item.

Both limbs are required there. A courier who leaves a parcel at the door is not within the definition; entry to place, assemble or install is what brings a company inside it.

"Residence" means a person’s principal or ordinary home or dwelling place, and includes an attached garage and any construction area attached to and accessible from the inhabited area or that garage.

The garage and construction-area extensions matter, because much of this work happens in exactly those spaces — a water heater in the garage, a system being installed in a part-built extension.

Each definition begins with "employs", which ties the chapter to the employment relationship and leaves a company using independent contractors outside it.
