Plain-English Summary

A short provision closing a gap the expedited timetable would otherwise leave.

In addition to any other order that may be issued under this subchapter or other law, a court of appeals or a trial court acting under the expedited review provisions may issue an injunctive order stating that the injunction remains in effect during the course of the trial or until lifted by the court.

The gap is one of duration. A temporary injunction is temporary, and the subchapter requires a trial or an appellate decision within 90 days. Where that deadline passes without a final determination, the order’s continued effect becomes uncertain.

This removes the uncertainty by letting the court say so expressly — the injunction continues through the trial, or until the court lifts it.

Both courts are given the power, the court of appeals hearing the expedited appeal and the trial court setting the merits trial, so whichever has the case can settle the question.

"Or until lifted by the court" preserves the ability to dissolve it. The order does not become permanent by continuing; it remains subject to the court that made it.

Read with the section before it, the two work together. That one forbids continuing the enjoined activity pending trial or appeal; this one ensures there is an order to comply with throughout.

"In addition to any other order" makes the power cumulative, so it adds to the court’s existing authority rather than defining its limits.
