Amendment History

§ 6-103 amended November 27, 2013.

Plain-English Summary

Setting time standards is only half the job; courts also need help meeting them. Section 6-103 puts that support in writing. Judges are entitled to assistance implementing the case progression standards, and the rule names two concrete forms that assistance should take: management reports that help judges track where their cases stand against the targets, and education on effective case management practices.

The rule keeps the list open-ended — assistance “shall include, but is not limited to” what it names — so the state court administration can add other forms of support as needs change. In practice, this rule is the administrative backbone behind Section 6-101’s disposition targets and Section 6-104’s juvenile case standards: it obligates the system to equip judges with the data and training to hit them, rather than leaving judges to meet ambitious standards without support.

Frequently Asked Questions

What kind of help is a judge entitled to under this rule?

Management reports that track case progress and information or education on effective case management practices, among other forms of assistance.

Is the list of assistance in Section 6-103 the only support judges can receive?

No. The rule states that assistance “shall include, but is not limited to” the listed items, leaving room for additional forms of support.

Does this rule set any deadlines for case disposition?

No. Section 6-101 sets the disposition time standards; Section 6-103 addresses the support given to judges to help them meet those standards.

Who is responsible for providing this assistance?

The rule directs that assistance be provided to the courts, which in practice comes through the state court administration.

Why does a rule about management reports matter to someone outside the court system?

It shows that Nebraska’s case progression standards come with a system for measuring and supporting compliance, rather than existing only as an aspirational goal.

How does this rule relate to the juvenile case progression standards?

The same implementation assistance obligation supports meeting the juvenile case time standards, since both sets of standards come from the same case progression framework.
