Plain-English Summary

Section 25-1580 covers the county judge’s own compensation for presiding over the debtor-discovery process. The judge is allowed a flat five dollars in each case, a figure set by a 1982 amendment and unchanged since. That flat fee comes in addition to whatever fees the law allows clerks of the district court for similar services, so the county judge’s total compensation combines the statutory five dollars with the going rate for comparable clerical work.

This fee is distinct from the compensation section 25-1579 authorizes for sheriffs, referees, receivers, and witnesses; that section covers the people who help carry out the examination, while section 25-1580 covers the county judge presiding over it. Both amounts are ultimately taxed as costs in the proceeding and collected from the party who ought to pay them.

Frequently Asked Questions

How much is the county judge paid for handling a debtor-examination case?

Five dollars per case, plus whatever fees the law allows district court clerks for similar services.

When was the five-dollar figure last set?

By a 1982 amendment, Laws 1982, LB 928, section 19, and it has not changed since.

Does this fee apply to district judges as well?

Who pays the county judge’s fee under this section?

Like the other costs of the proceeding, it is taxed and collected from whichever party ought to pay it, following the same approach section 25-1579 describes for other participants’ compensation.

Is this fee separate from what referees, sheriffs, and witnesses are paid?

Yes. Section 25-1579 governs compensation for sheriffs, referees, receivers, and witnesses; section 25-1580 covers only the county judge’s own fee.
