Plain-English Summary
An order that nobody can enforce because nobody can find the payer is no order at all. This section builds the reporting duty into the order itself.
Address. Every child support or maintenance order includes an order that payer and payee notify the county child support agency of any change of address within 10 business days.
Employer and income. The same order requires both to notify the agency and each other, within 10 business days, of a change of employer and of any substantial change in gross income affecting the ability to pay or the amount owed. It must also carry a warning that reporting a change does not by itself change the order — a revision or an annual adjustment has to be sought.
Remarriage. A maintenance order requires the payee to tell the court and the payer within 10 business days of remarrying. That is the notice on which the payer's right to have the order vacated depends.
Child support only. Where a payer is ordered to pay child support alone, neither party has to disclose income the department does not treat as gross income, and the payee need not report a change of employer or income unless the payer is a shared-placement parent — a parent with at least 25 percent court-ordered placement who was ordered to take a proportionate share of the basic support costs.
The rest. Each party gives the agency their social security number, addresses, telephone number, driving licence number and employer details, and updates them within 10 business days of a change. The same redaction list as the annual exchange applies to what goes to the other party. Failing to furnish information is contempt, and can carry costs and reasonable attorney fees.
