§ 1122.Uniform Civil Remedies For Unauthorized Disclosure of Intimate Images Act - Definitions

Before the new Act's cause of action can operate, this section pins down what its key words mean. “Consent” requires affirmative, conscious, and voluntary authorization from someone with the legal capacity to give it. “Disclose” or “disclosure” means transferring, publishing, or distributing an image to another person. “Identifiable” covers a depicted individual recognizable either from the image itself or from the image paired with an identifying characteristic.

“Intimate image” gets a specific, two-part definition: a photograph, film, video, or similar medium showing a depicted individual's uncovered genitals, pubic area, anus, or post-pubescent female nipple, or showing the individual engaged in or subjected to sexual conduct. That last term, “sexual conduct,” is itself defined to include masturbation, several forms of sexual intercourse or penetration, bestiality, and the transfer of semen onto a depicted individual. These definitions carry over into every other section of the Act once it takes effect on November 1, 2026.
