Virginia Divorce Forms: What the State Provides and What Your Court Wants

Virginia family law · Last reviewed October 27, 2026

Virginia doesn't publish a statewide fill-in divorce complaint or final decree. The court self-help site's divorce forms page lists one court-approved form, the no-fault fee waiver, and for the no-fault divorce itself it points to the legal aid website's "online forms and guidance for filing a No-Fault Divorce." Several circuit court clerks also publish packets of sample papers. What the state does provide are the supporting forms below.

Official forms used in a divorce

FormNameWhen you need it
CC-1416Cover Sheet for Filing Civil ActionsWith the complaint; some clerks, Fairfax among them, ask for their own domestic case cover sheet
VS-4Report of Divorce or AnnulmentWith the complaint; Fairfax provides it at its civil intake desk
CC-1406Acceptance/Waiver of Service of Process and Waiver of Future Service of Process and NoticeWhen your spouse accepts or waives service instead of being served
CC-1407Service Other Than by Virginia SheriffProof of service by a private process server or out-of-state service
CC-1435Affidavit for Order of PublicationWhen your spouse can't be found or lives outside Virginia and publication is needed
CC-1426Addendum for Protected Identifying Information (Confidential)Social Security and account numbers, kept out of the public papers
CC-1421Petition for Proceeding in a No-Fault Divorce Without Payment of Fees or CostsFee waiver in a no-fault divorce
CC-1414Petition for Proceeding in Civil Case Without Payment of Fees or CostsFee waiver in other civil cases
DC-637Child Support Guidelines WorksheetChild support in sole custody cases, and the starting point for the others
DC-640Child Support Guidelines Worksheet (Shared Custody)Child support when each parent has the children more than 90 days a year

The worksheet a court relies on must be put in the court file, with a copy to the parties (§ 20-108.2(B)).

The papers you draft or get from a packet

  • Complaint for divorce, stating the ground, residency, the date of separation, and any children, and asking for whatever relief you want (property, support, custody, name restoration).
  • Affidavit of the party, if you're proving a no-fault divorce on the papers. It must cover each point in § 20-106(B); see uncontested divorce.
  • Separation agreement, if you have one.
  • Final decree, which must include each party's Social Security number or DMV control number "if known and available" (§ 20-91(B)); the numbers themselves go on the CC-1426 addendum.
  • Order restoring a former name, a separate order under § 20-121.4.

Local packets

Clerks write their own instructions, and the details differ: the number of copies, cover sheet, envelopes, whether they take mailed or e-filed papers. Three examples:

  • Fairfax asks for the original complaint and a copy for service, a domestic case cover sheet, and the VS-4 "completed in black ink", and publishes a pro se divorce package prepared with the county bar. New divorce cases there can be filed electronically.
  • Alexandria publishes an uncontested divorce packet (posted January 2026).
  • Henrico lists the papers to file and the order granting a name change, if you want one.

A packet is a guide, not a statewide form. Clerks can't give legal advice, and Fairfax reminds filers that "Court personnel are prohibited by state law from giving you legal advice or assistance."

Filing

File in the circuit court where you last lived together, or where your spouse lives if your spouse lives in Virginia (§ 8.01-261). Electronic filing in circuit court runs under Rule 1:17 and each clerk's own system; ask your clerk whether self-represented filers can use it.

Frequently asked questions

Does Virginia have official divorce forms?

Only supporting forms: the cover sheet, service and waiver forms, the confidential addendum, fee waivers, and child support worksheets. There's no statewide complaint or decree form. The court site points no-fault filers to legal aid's online forms, and many clerks publish packets.

What form does my spouse sign to accept service?

Form CC-1406, signed before a notary or a clerk. In a no-fault case it can be signed shortly before or after you file, with the complaint attached, and your spouse must also sign the proposed decree.

Where do I put Social Security numbers?

On form CC-1426, the confidential addendum. Pleadings, agreements, and decrees under the divorce chapter must not show Social Security numbers or identifying account numbers.

Which child support worksheet do I use?

DC-640 when each parent has the children for more than 90 days a year; otherwise DC-637. See child support.

Can I e-file my divorce in Virginia?

Some circuit courts accept electronic filing of new divorce cases, Fairfax among them. Ask your clerk.
