Michigan Divorce Forms: The SCAO-Approved Forms You'll Need, and the Ones That Don't Exist
Michigan family law · Last reviewed October 23, 2026
Michigan's court forms are approved by the State Court Administrative Office (SCAO) and posted on the Michigan courts' forms pages. One thing surprises most people: there is no SCAO form for the complaint for divorce or the judgment of divorce. Those documents are drafted for each case, by a lawyer or with a document-assembly tool, and must meet the court rules on what they contain (MCR 3.206 for the complaint and MCR 3.211 for the judgment). The forms below fill in around them.
Starting a case by complaint
| Form | Name | When |
|---|---|---|
| MC 01 | Summons | Issued by the clerk when the complaint is filed; includes the proof of service |
| MC 21 | Confidential Case Inventory | Lists other cases involving the family (MCR 3.206(A)) |
| MC 416 | Uniform Child Custody Jurisdiction Enforcement Act Affidavit | With minor children |
| FOC 23 | Verified Statement | With children or support; given to the Friend of the Court and served on the other party |
| MC 20 | Fee Waiver Request | If you can't afford the fees |
During the case
| Form | Name | When |
|---|---|---|
| CC 320 | Domestic Relations Verified Financial Information Form | Exchanged within 28 days after the first responsive pleading. "Do not file this document with the court." |
| MC 07 | Default Request and Entry | If your spouse doesn't answer |
| CC 99d | Motion to Set Aside Default/Default Judgment (Domestic Relations) | If a default needs to be undone |
| MC 282 | Domestic Violence Screening for Referral to Mediation | When the court considers mediation |
| FOC 61 | Objection to Ex Parte Order (Domestic Relations) | To object to an emergency order; the April 2026 version is required |
| FOC 61a | Motion to Modify or Rescind Ex Parte Order (Domestic Relations) | A new form, April 2026 |
The joint petition set
For spouses who agree on everything and file together under MCR 3.223:
| Form | Name |
|---|---|
| CCFD 25 | Petition (Consent Judgment) |
| CCFD 26 | Notice of Request to Enter Consent Judgment/Order |
| MC 282a | Domestic Violence Screening, one for each spouse |
The notice warns that "Both parties must be present for this hearing in accordance with MCR 3.223(D)." Collaborative law cases use CCFD 24, Petition (Collaborative Law Process).
The judgment and support orders
| Form | Name |
|---|---|
| FOC 10 | Uniform Child Support Order (revised November 2025) |
| FOC 10a | Uniform Child Support Order, No Friend of the Court Services |
| FOC 10b / FOC 10c | Uniform Spousal Support Order, with or without Friend of the Court services |
| FOC 10d | Uniform Child Support Order (Deviation Addendum) |
| FOC 100 | Domestic Relations Judgment Information |
| DCH-0838 | Record of Divorce or Annulment (the state's vital-records report) |
Any child or spousal support must be on "the latest version of the Uniform Support Order approved by the state court administrative office," signed by the judge with the judgment (MCR 3.211(D)). Older child support order forms (the December 2024 version) could be used only until February 6, 2026.
When the record of divorce is filed depends on which source you read: the vital records statute and the state health department say to file DCH-0838 with the petition, while the court rule says it is filed with the judgment. Follow your county clerk's instructions.
Filing: paper or e-filing
Whether you can file electronically depends on your county. As of the state's October 2026 list, Oakland, Ottawa, Washtenaw, Hillsdale and a few Upper Peninsula circuits accept divorce filings electronically from the start, and Oakland requires it. Macomb accepts divorce filings electronically only after the case is started; Wayne and Kent don't accept domestic filings through the state system. Filing electronically never serves your spouse; service is separate.
Frequently asked questions
Where can I get Michigan divorce forms?
From the State Court Administrative Office's forms pages on the Michigan courts website. The complaint and judgment aren't among them; they're drafted for each case.
Is there a free Michigan divorce complaint form?
There's no SCAO-approved complaint form. Many courts' self-help centers point people to free document-assembly tools that draft a complaint meeting MCR 3.206.
What forms do we need for an uncontested joint divorce in Michigan?
A joint petition (CCFD 25), a signed proposed judgment, a domestic violence screening form (MC 282a) for each spouse, and, with children, the Friend of the Court forms and uniform child support order.
Do I file the financial information form with the court?
No. The CC 320 is exchanged with your spouse; only proof that you served it is filed.
Can I file for divorce online in Michigan?
In some counties. Check the state's e-filing court list for your circuit court.
