Text size

When an injunction is wholly dissolved the bill shall stand dismissed with costs, unless sufficient cause be shown against such dismissal.

Plain-English Summary

Dissolution of an injunction can carry a consequence for the whole case, not just the injunctive relief itself. Once an injunction tied to a bill is wholly dissolved, this section dismisses that bill with costs by default.

The dismissal is not unavoidable, though. If sufficient cause is shown against dismissing the case, it survives despite the dissolved injunction — the underlying claim may still have merit worth pursuing even after the emergency relief that once accompanied it falls away. And because the section speaks to an injunction “wholly” dissolved, a partial dissolution does not automatically trigger this dismissal consequence at all.

Frequently Asked Questions

What happens to the underlying bill when an injunction is wholly dissolved?

It stands dismissed, with costs, unless sufficient cause is shown against dismissal.

Is dismissal automatic and unavoidable?

No — dismissal can be avoided if sufficient cause is shown against it.

Does a partial dissolution trigger this automatic dismissal?

The section addresses an injunction that is “wholly” dissolved, so a partial dissolution does not fall within its plain terms.

Who bears costs on dismissal?

The bill is dismissed with costs, consistent with the party who sought the now-dissolved injunction bearing that expense.

Does this section apply to injunctions generally or to the bill for which the injunction was awarded?

It applies to the bill for which the injunction was awarded once that injunction is wholly dissolved.
