Amendment History

R.L. 1910, § 5228.

Plain-English Summary

For routine procedural steps -- motions, continuances, amendments, and the like -- this section doesn't fix who pays. It leaves the taxing and payment of those particular costs to whatever the court, in its discretion, directs, except where some other statute already covers the point.

Frequently Asked Questions

Who pays the costs of a continuance or amendment in an Oklahoma civil case?

Whoever the court directs, in its discretion, unless another statute already specifies.

Does this section set a default rule favoring either party?

No. It gives the court discretion instead of assigning those costs to a particular side.

How does this section relate to the general costs-to-the-prevailing-party rules?

Those broader rules, in Sections 928 through 930, cover costs on the judgment as a whole; this section covers the incidental costs of motions and similar procedural steps along the way.
